Appeal by John Kitto and Vicki Holten, agents for John Taylor for a <br /> Special Exception Permit as provided by Section 11.05(3) to permit filling, <br /> grading, etc. , within 300 feet of Lake Waubesa being Lots 23 and Part of Lot <br /> #22, Morris Park at 4198 Morris Park Road - Section 9, Town of Dunn. <br /> IN FAVOR: V. Holten OPPOSED: --- COMMUNICATION: Town Board. <br /> Gaskill/Lynch to grant with conditions, permit to fill, grade, terrace and <br /> install retaining walls as proposed. <br /> CONDITIONS: <br /> 1). That plans and specifications be prepared by a licensed engineer within <br /> the scope of the application, and filed with the Zoning Department before <br /> commencement of any work. <br /> 2). That all work be performed in compliance with approved engineering <br /> standards and all applicable governmental rules and regulations particularly <br /> Section 11.05(4) of Dane County Zoning Ordinance. <br /> 3). That there be filed with the Zoning Department a certificate of <br /> compliance by a licensed engineer at the completion of the project. <br /> 4). As per Cliff Lawson plans and specifications as submitted. <br /> 5). Completion deadline of 6/30/93. <br /> FINDING OF FACT: <br /> 1). Project is intended to repair crumbling retaining walls, terrace severe <br /> slopes and contour grassed areas to <br /> prevent erosion and enchance asthetics. <br /> 2). Project under professional engineer supervision. <br /> 3). Project will incorporate new boathouse construction and shoreline rip-rap. <br /> CONCLUSION: <br /> 1). The project as planned, with specified conditions; will not result in <br /> substantial detriment to navigable waters by erosion, sedimentation, <br /> impairment of fish or aquatic life, or safe and healthful conditions. <br /> Motion carried - 3-0. <br /> #2287. Appeal by E. Jane Homan for a variance from required setback from <br /> normal high watermark as provided by Section 11.03(2) to permit deck addition <br /> to existing residence at 5640 Tall Oaks Road being Lot #91 1st Addition Mary <br /> Lake - Section 21, Town of Westport. <br /> (Withdrawn by applicant). <br /> #2288. Appeal by Dennis Wake for a variance from required sideyard as <br /> provided by Section 10.07(7) to permit dear addition to existing residence at <br /> 2088 Barber Drive being Lot #14, Lincoln Park - Section 26, Town of Dunn. <br /> IN FAVOR: D. Wake OPPPOSED: --- COMMUNICATION: Town Board <br /> Gaskill/Lynch to deny requested variance from required left sideyard to permit <br /> deck encroachment as proposed. <br /> FINDING OF FACT: <br /> 1). Applicant proposed 12' x 25' deck addition to existing residence which <br /> would continue existing building line of residence. <br /> 2). Applicant has buildable area extending toward lake without sideyard <br /> encroachment. <br /> 3). Design changes appear to relieve concerns over blocking window of <br /> residence. <br />
