BOA 8/27/92 Minutes <br /> Page 9 <br /> I CyFINDING OF FACT: <br /> 1). Lot is sufficiently small and irregular shaped as to warrant some relief. <br /> 2). Property drops severely away from road the further back the lot goes. <br /> 3). Adjoining structure nearer to road than proposed for this lot. <br /> CONCLUSION: <br /> 1). Variance is necessary to provide right enjoyed by others. <br /> 2). Variance is not contrary to rights of others or to the public interest. <br /> Motion carried - 3-0. <br /> Also: <br /> Dreps/Gaskill to deny requested setback Variance from Quam Point Drive to <br /> permit construction of new single family residence on Easterly (larger lot) as <br /> proposed. <br /> FINDING OF FACT: <br /> 1). Property has considerably larger buildable areas than does adjoining lot. <br /> 2). Adjoining property has structure setback further than requested for this <br /> lot. <br /> 3). Road right-of-way is extremely narrow, being only 24.9 feet, and any <br /> on-street parking presents congestion. <br /> CONCLUSION: <br /> 1). Unnecessary hardship was not proven. <br /> Motion carried - 3-0. <br /> #2296. Appeal by Klay Construction, agent for Mike Othrow for a variance from <br /> required setback from road as provided by Sections 10.16(5)(b) and 10.17(5) to <br /> permit residence reconstruction from tornado damage at 2455 Hillpoint Road <br /> IN FAVOR: J. Klehfoth OPPOSED: --- COMMUNCATION: Town Board <br /> Gaskill/Dreps to grant Variance of 1.79 feet from required setback to <br /> Hillpoint Road to permit porch to be included with reconstruction of residence <br /> destroyed by tornado. <br /> FINDING OF FACT: <br /> 1). Residence reconstruction is over existing foundation and identical to <br /> that which was destroyed by July 1992 tornado. <br /> 2). Right-of-way curves inward towards property. <br /> 3). Home originally built and Certificate of Compliance was issued while <br /> structure in violation. <br /> 4). Porch is to be roofed over and not to be enclosed. <br /> CONCLUSION: <br /> 1) . Variance is not contrary to rights of others or to the public interest. <br /> 2). Variance preserves the Zoning Ordinance as much as possible without <br /> injustice to applicant. <br /> Motion carried - 3-0. <br /> #2297. Appeal by Scott Sign Company, agent for Meier GMC Truck for a variance <br /> from required height and maximum square footage of on-premise pylon sign as <br /> provided by Section 10.74(19) to permit proposed sign at 200 West Beltline <br /> Highway being part of Lot #2, Block 2, Jacobs and Barker Subdivision —Section <br /> 36, Town of Madison. Also, Appeal of Zoning Administrator's interpretation of <br /> provisions of Dane County Zoning Ordinance 10.74(19) pertaining to sign height <br /> and area requirements. <br /> IN FAVOR: G. Antoniewicz, J. Meier OPPOSED: --- COMMUNICATION: --- <br /> Bill Fleck addressed the Board with Zoning Administrator's position. <br /> Gaskill/Lynch to hold request until September Hearing to allow input of <br /> additional materials. <br /> Motion carried - 3-0. <br />
