Motion carried <br /> - 3-0. <br /> Also, Lynch/Gaskill to grant variance 16 feet from required average setback to <br /> normal high watermark to permit 12' x 12' uncovered deck addition and <br /> construction of new residence utilizing existing foundation. 3-0. Motion <br /> carried. <br /> FINDING OF FACT: <br /> 1) . Applicant has withdrawn request for variances from required right <br /> sideyard and variance from maximum allowable lot coverage. <br /> 2). Appeal is to raze existing residence down to foundation and constructing <br /> upwards from there. <br /> 3). Adjoining property has garage nearer to right-of-way than existing or <br /> proposed structure. <br /> 4). Chimney chase has been deleted and fireplace moved within buildable area <br /> removing need for variance. <br /> 5). 12' x 12' open deck will meet required left sideyard requirement and <br /> replaces existing deck in same location. <br /> 6). Many nonconforming rsidences in immediate area. <br /> CONCLUSION: <br /> 1). Variance is not contrary to rights of others or to the public interest. <br /> 2). Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> Motion carried - 3-0. <br /> #2344. Appeal by Frank & Patricia J. Abela dba Country Corners Bar for a <br /> variance from required setback from normal high watermark as provided by <br /> Section 11.03(2) to permit addition to existing tavern at 3737 CTH AB in the <br /> SE 1/4 SE 1/4 - Section 24, Town of Blooming Grove. <br /> IN FAVOR: T. Abela OPPOSED: --- COMMUNICATION: County Highway, <br /> Environmental Health <br /> Gaskill/Lynch to hold appeal in abeyance, not beyond February Hearing, to <br /> allow additional input from Environmental Health Department regarding septic <br /> suitability. <br /> Motion carried - 3-0. <br /> #2345. Appeal by Landmark Building Systems, agent for Harker Heating and <br /> Cooling, Inc. for a variance from required sideyard as provided by Section <br /> 10.13(6) to permit addition to existing commercial building at 2155 CTH MM <br /> (Rimrock Road) in the NE 1/4 NW 1/4 - Section 36, Town of Madison. <br /> IN FAVOR: T. Hyer, J. Sparr OPPOSED: --- COMMUNICATION: Town Board, <br /> County Highway. <br /> Lynch/Gaskill to grant, with conditions, variance of 7 feet from required left <br /> sideyard to permit addition to existing commercial building. <br /> CONDITION: <br /> 1). That proposed addition extend no nearer than 25 feet to adjoining <br /> Pelliteri Building. <br /> 2). New addition be protected with heat detection alarm system which will be <br /> monitored 24 hrs. a day, be installed. <br />
