ORDINANCE AMENDMENT NO. 5395 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of <br /> BERRY <br /> The Dane County Board of Supervisors does ordain as follows: That the <br /> Zoning District Maps of the Town of Berry be amended to include in the C-2 <br /> Commercial District the following described land: <br /> Part of the NW 1/4 NW 1/4 Section 10, Town of Berry described as follows: <br /> Beginning 364.5 feet East of the Northwest corner of said Section 10; thence <br /> East 453 feet; thence South 128 feet; thence East 165 feet; thence South 103 <br /> feet; thence West 618 feet; thence North 231 feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3) (a) of the <br /> Dane County Code of Ordinances. The rezoned area shall be subject to a <br /> delayed effective date subject to the fol lowing: <br /> DEED RESTRICTION REQUIRED <br /> The owner or owners of the land shall , within 90 days of approval of this <br /> rezone by Dane County, record the following restrictions on said land: <br /> A. Use of the property is limited to repair of farm tractors, farm <br /> machinery and motor vehicles. <br /> • B. No more than 5 tractors or motor vehicles (combined total ) are permitted <br /> to be stored or parked outside overnight. <br /> C. Construction of any structure to be located on the property requires <br /> approval of the Town Board. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town <br /> Board as well as the owners of property located within 300 feet of the site. <br /> Failure to record the restrictions will cause the rezone to be null and void. <br /> CONDITION <br /> This amendment will become effective upon application for a change of zoning <br /> from C-2 Commercial to R-3 Residential on the existing shop property, Parcel <br /> #0807-102-8600. Failure to follow through with the rezone process for the <br /> existing shop property shall null and void this amendment. <br /> CERTIFIED SURVEY REQUIRED <br /> The owner or owners of the land shall within 90 days of approval of this <br /> rezone by Dane County prepare a certified survey map that describes the land <br /> to be rezoned. Said survey shall be submitted to Dane County for approval and <br /> recorded in the office of the Dane County Register of Deeds. Failure to <br /> record the survey will cause the rezone to be null and void.__--_- <br /> EFFECTIVE DATE: FEB i 7 994 \1 <br />
