Haag, husband and wife, (the <br /> "Owner") , is the Owner of the following described land in the Town <br /> of Berry, Dane County, Wisconsin, to-wit: <br /> Part of the NW1/4-NW1/4 Section 10, Town of Berry, described <br /> as follows: Beginning 364.5 feet East of the Northwest corner <br /> of said Section 10; thence , East 453 feet; thence South 128 <br /> feet; thence East 165 feet; thence South 103 feet; thence West <br /> 618 feet; thence North 231 feet to the point of beginning. • <br /> (Said parcel also being described as Lot 1, CSM 0 7347 <br /> recorded in Volume 3' of Certified Surveys, Page "S -4. 4 , <br /> Document a a..S'l1,3 y ) ; and <br /> WHEREAS, said Owner desires to place certain restrictions <br /> thereon, to bind the Owner and those who may acquire title <br /> hereafter; <br /> NOW, THEREFORE, in consideration of the mutual benefits <br /> passing to and from the Owner and those who may hereafter purchase <br /> said land and the parties named as beneficiaries of these <br /> restrictions, the following restrictions are hereby imposed: <br /> 1. Use of the property is limited to: <br /> • <br /> (a) Repair of farm tractors, farm machinery and motor <br /> vehicles. <br /> (b) No more than 5 tractors or motor vehicles (combined <br /> total) are permitted to be stored or parked outside <br /> overnight. <br /> (c) Construction of any structure to be located on the <br /> property requires approval of the Town Board. <br /> These restrictions shall constitute covenants running with the <br /> land and shall be binding upon all parties now owning any part of <br /> said land, their successors, heirs and assigns, and all parties <br /> holding under them unless, pursuant to Paragraphs 5 or 6 of this <br /> I instrument, said restrictions are amended or terminated. <br /> • <br />
