ORDINANCE AMENDMENT NO. 5390 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of <br /> MEDINA <br /> The Dane County Board of Supervisors does ordain as follows: That the <br /> Zoning District Maps of the Town of Medina be amended to include in the RH-2 <br /> Rural Homes District the following described land: <br /> Part of the NW 1/4 NE 1/4 Section 23, Town of Medina described as follows: <br /> Commencing at the Northeast corner of said Section 23; thence West along the <br /> North line of said Northeast quarter, 1336 feet to the Northeast corner of said <br /> NW 1/4 NE 1/4; thence South along the East line of said 1/4 1/4, 200 feet to <br /> its intersection with the centerline of Boxelder Road, and the point of <br /> beginning; thence continue South along said East line, 325 feet; thence West, <br /> 720 feet; thence North 435 feet to the centerline of said Boxelder Road; thence <br /> S 81° East along said centerline, 730 feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) <br /> of the Dane County Code of Ordinances. The rezoned area shall be subject to <br /> the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed description is intended to describe land for which a <br /> certified survey map will be prepared for approval and recorded. This <br /> amendment will become effective, if within 90 days of its approval by Dane <br /> County, a certified survey map that describes the land to be rezoned is <br /> recorded in the office of the Dane County Register of Deeds. Failure to <br /> record the survey will cause the rezone to be null and void. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane <br /> County the owner or owners of the land shall record the following restrictions <br /> on the primary property from which the rezone parcel listed above is to be <br /> divided: <br /> A. Development of homesites on this land is not permitted. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town <br /> Board as well as the owners of the land. Failure to record the restrictions <br /> will cause the rezone to be null and void. <br /> / Q4 <br /> EFFECTIVE DAT . 1 1�J \ <br />
