WHEREAS, ."-,Teo-r4 a &i9� ,..<5-74/LT T c= is/are <br /> the owner/a of the following d scribed land in the Town of /7244 4 <br /> Dane County, Wisconsin, to-wit: VOL 20518PAG1 7 <br /> Part of the NW 1/4 NE 1/4 Section 23, Town of Medina described as follows: <br /> Commencing at the Northeast corner of said Section 23; thence West along the <br /> North line of said Northeast quarter, 1336 feet to the Northeast corner of <br /> said NW 1/4 NE 1/4; thence South along the East line of said 1/4 1/4, 200 feet <br /> to its intersection with the centerline of Boxelder Road, and the point of <br /> beginning; thence continue South along said East line, 325 feet; thence West, <br /> 720 feet; thence North 435 feet to the centerline of said Boxelder Road; <br /> thence S 81' East along said centerline, 730 feet to the point of beginning. <br /> 3. NOW, THE►tEFORE, in consideration of the mutual benefits passing to and <br /> from the owner and those who may hereafter purchase said land and the <br /> parties named as beneficiaries of these restrictions, the following <br /> restrictions are hereby imposed: <br /> A. Development of homesites on this land is not permitted. <br /> These restrictions shall constitute covenants running with the land and <br /> shall be binding upon all parties now owning any part of said land, their <br /> successors, heirs and assigns, and all parties holding under them unless, <br /> pursuant to paragraphs 5 or 6 of this instrument, said restrictions are <br /> amended or terminated. <br /> 4. The restrictions provided for herein shall be enforceable at law or <br /> equity against any party who has or acquires an interest in the land <br /> subject to the restriction by the following parties who are named as <br /> grantees, promisees and beneficiaries with enforcement rights: <br /> (a) The County Government of Dane County, Wisconsin provided that the <br /> lands are under the jurisdiction of zoring ordinance of said County <br /> at the time the enforcement action is commenced; and <br /> (b) The�' o G9vernment of the Town - - - <br /> of G O/#1 <br /> Dane County, Wisconsin provided that the lands are within the <br /> governmental jurisdiction of said Town at the time the enforcement <br /> action is commenced. <br /> (c) The owner(s) of record of any land/■ which are located within the <br /> district subject to the regulations of this ordinance. <br /> \)( <br /> 9"1-' <br />
