BOARD OF ADJUSTMENT <br /> MINUTES OF DECEMBER 22 , 1994 <br /> PRESENT: Klopp, Quackenbush, Dreps and Gaskill. <br /> ALSO PRESENT: Fleck and Reynolds. <br /> Meeting called to order at 6: 30 P.M. in Room 2-E City-County <br /> Building, by Chairman Quackenbush to hold public hearing as <br /> published by Class II Notice. <br /> Minutes Gaskill/Klopp to approve minutes of November 10 and 17 , <br /> 1994 . Motion carried - 4-0. <br /> #2586. Appeal by Joseph Lehman for a variance from required <br /> setback from road as provided by Section 10 . 17 (1) & (2) to permit <br /> addition/alteration of existing residence at 1313 STH 19 in the NW <br /> 1/4 SW 1/4 - Section 8 , Town of Medina. <br /> IN FAVOR: J. Lehman OPPOSED: --- COMMUNICATION: <br /> Environmental Health Department, County Highway. <br /> GASRILL/DREPS to grant, with condition, Variance of 29 . 1 feet to <br /> required setback to centerline STH 19 and Variance of 6 . 4 feet to <br /> required setback to centerline CTH TT to permit additions to <br /> residence as constructed. c422. AvA,6,,,,› 1_ Zoo 5 0: 50. Mradc.. <br /> C, CONDITION: <br /> 1) . Additions shall be removed at the owner's expense if future <br /> road improvement requires additional right-of-way. <br /> FINDING OF FACT: <br /> 1) . Construction commenced without necessary permits. <br /> 2) . Second story addition within existing footprint. <br /> 3) . Kitchen addition extends 2 . 0 feet further towards CTH TT than <br /> did original structure. <br /> 4) . Original structure not habitable do to disrepair and rodent <br /> infestation. <br /> 5) . If highway expansion necessary it is intended to go away from <br /> property. <br /> CONCLUSION: <br /> 1) . Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. <br /> 2) . Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried. 4-0. <br /> #2587 . Appeal by John and Sherry Hoffman for a variance from <br /> required setback from road as provided by Section 10. 17 (1) to <br /> permit roof alteration of existing residence at 1700 STH 92 in the <br /> E 1/2 SW 1/4 - Section 34, Town of Springdale. <br /> IN FAVOR: J & S Hoffman OPPOSED: --- COMMUNICATION: <br /> Environmental Health Department <br /> 4C., DREPS/GASRILL to grant Variance of 49 feet to required setback <br /> centerline of STH 92 to permit changing roof line of existing <br /> structure. <br />
