BOA MINUTES 11/17/94 PAGE 4 #2574. Welsh/Hangartner - Dunn - 10/27/94 P.H. Dreps/Klopp to grant with conditions permit to fill grade and retaining walls after construction of residential garage. CONDITIONS: 1) . That plans and specifications be prepared by a licensed engineer within the scope of the application, and filed with the Zoning Department before commencement of any work. 2) . That all work be performed in compliance with approved engineering standards and all applicable governmental rules and regulations particularly Section 11. 05 (4) of Dane County Zoning Ordinance. 3) . That there be filed with the Zoning Department a certificate of compliance by a licensed engineer at the completion of the project. 4) . Completion and certification deadline of June 1, 1995. FINDING OF FACT: 1) . Applicant was granted Variance from required setback to right- of-way at October 27 , 1994 Hearing. 2) . Lot slopes away from road towards Lake Waubesa. 3) . 2-Story garage needed to bring floor level with grade of Morris Park Road. 4) . Engineering provided by J. Brady Farrell, Professional Engineering. CONCLUSION: 1) . The project as planned, with specified conditions; will not result in substantial detriment to navigable waters by erosion, sedimentation, impairment of fish or aquatic life, or safe and healthful conditions. Motion carried - 4-0. #2576. Gilson - Westport - 10/27/94 KLOPP/DREPS to grant permit for fill, grade and retaining wall as constructed. FINDING OF FACT: 1) . Project started on adjoining property and during construction bank gave way. 2) . Retaining walls needed immediately to maintain lawn from washing into lake. 3) . Engineering and certification have been provided by Ron Klaas Professional Engineering. Motion carried - 4-0. #2566.
