Property is surrounded by water on 3-sides. <br /> 3) . Previous Variance (#1056) granted in 1982 for <br /> addition/alteration. <br /> 4) . Deck constructed 2± years ago without necessary permits. <br /> 5) . Sideyard is presently conforming. <br /> CONCLUSION: <br /> 1) . Variance is not contrary to rights of others or to the public <br /> interest. <br /> 2) . Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. <br /> APPEALS FROM PREVIOUS HEARINGS: <br /> #2568. Gombar OPPOSED: D & L Kalscheur <br /> COMMUNICATION: Town Board <br /> DREPS/GASKILL to grant, with conditions, Special Exception Permit <br /> to fill, grade and retaining wall as per plans submitted for lot <br /> drainage after construction of new residence. <br /> CONDITIONS: <br /> 1) . That plans and specifications be prepared by a licensed <br /> engineer within the scope of the application, and filed with the <br /> Zoning Department before commencement of any work. <br /> 2) . That all work be performed in compliance with approved <br /> engineering standards and all applicable governmental rules and <br /> regulations particularly Section 11. 05 (4) of Dane County Zoning <br /> Ordinance. <br /> 3) . That there be filed with the Zoning Department a certificate <br /> of compliance by a licensed engineer at the completion of the <br /> project. <br /> 4) . Inspection and approval by Zoning Department upon completion <br /> of project._ <br /> 5) . Completion and certification deadline of June 1, 1995. <br /> FINDING OF FACT: <br /> 1) . Engineering provided by Cleveland Gombar Professional <br /> Engineering. <br /> 2) . Property has steep slope towards Morris Park Road into which <br /> driveway, with retaining walls, have been cut. <br /> 3) . Erosion stabilization measures are already in place. <br /> CONCLUSION: <br /> 1) . The project as planned, with specified conditions; will not <br /> tr. result in substantial detriment to navigable waters by erosion, <br /> sedimentation, impairment of fish or aquatic life, or safe and <br /> healthful conditions. Motion carried - 4-0. <br />
