Watkins OPPOSED: --- COMMUNICATION: Albion <br /> Building Inspector <br /> Gaskill/Dreps to grant Variance of 13 feet from required setback to <br /> right-of-way of Hickory Nut Lane to allow construction atop <br /> existing garage also to allow enclosed entry at 15 feet and covered <br /> porch at 17 feet from required right-of-way as proposed. Motion <br /> carried 4-0. <br /> Gaskill/Dreps to grant variance of 2 feet from both right and left <br /> sideyard to permit additions/alterations to existing residence as <br /> proposed. Motion carried 4-0. <br /> Gaskill/Klopp to deny Variance to allow 3rd story addition as <br /> proposed. Motion carried - 4-0. <br /> FINDING OF FACT: <br /> 1) . Project is intended to add to existing residence and almost <br /> entirely maintain existing footprint. <br /> 2) . Structure to be lifted and new foundation installed. <br /> 3) . Property is in an area of numerous nonconforming structures <br /> with many variances being granted. <br /> 4) . 3rd Story addition is proposed to offer applicant view of <br /> lake. <br /> CONCLUSION: <br /> Setback and Sideyards: 1) . Variance preserves the zoning <br /> ordinance as much as possible without injustice to applicant. <br /> 2) . Variance is not contrary to rights of others or to the public <br /> interest. <br /> 3rd Story: 1) . Unnecessary hardship was not proven. <br /> #2585. Appeal by James W. Schluter for a variance from required <br /> setback from normal high watermark and sideyard as provided by <br /> Section 11. 03 (2) and 10. 07 (7) to permit additions to existing <br /> single family residence at 2951 Camp Leonard Road in the SE 1/4 SE <br /> 1/4 - Section 4, Town of Dunn. <br /> IN FAVOR: J. Schluter, E. Pottinger OPPOSED: -- COMMUNICATION: <br /> Town Board <br /> Gaskill/Klopp to grant with conditions Variance of 10 feet± from <br /> required setback to normal high watermark, which equals setback of <br /> existing resdience, to allow residential addition as proposed also <br /> to grant Variance of 18 feet± from required setback to normal high <br /> watermark to permit deck addition as constructed. <br /> CONDITIONS: <br /> 1) . That applicant obtain all other necessary government agency <br /> approvals. <br /> 2) . Existing garage be removed. Motion carried - 4-0. <br /> Irior Gaskill/Klopp to hold requested sideyard Variance, not beyond <br /> January Hearing, to allow applicant, to explore alternative designs <br /> to reduce encroachment. Motion carried - 4-0. <br />
