BOARD OF ADJUSTMENT MINUTES <br /> HELD ON September 22, 1994 <br /> PRESENT: Gaskill, Dreps, Klopp and Quackenbush. <br /> ALSO: Reynolds. <br /> Meeting called to order at 6: 35 P.M. by Chairman Quackenbush to <br /> hold Public Hearing in Room 2-F City-County Building as published <br /> by Class II Notice. <br /> MINUTES: Gaskill/Klopp to approve minutes of August 25, 1994. <br /> Motion carried - 4-0. <br /> SEPTEMBER AGENDA ITEMS: <br /> #2554. Appeal by Mark Kanvik for a variance from required rearyard <br /> as provided by Section 10. 07 (8) to permit construction of new <br /> single family residence at 118 Highwood Drive being Lot #17, Block <br /> #9, Highwood Estates Third Addition - Section 36, Town of Albion. <br /> IN FAVOR: M. Kanvik, L. Ashpole, C. Rybarczyk OPPOSED: --- <br /> COMMUNICATION: Town Board. <br /> Gaskill\Dreps to grant variance of 16. 5 feeet from required <br /> rearyard to permit construction of new single family residence as <br /> proposed. <br /> FINDING OF FACT: <br /> 1) . Applicant wishes to reconstruct on site of demolished <br /> residence. <br /> 2) . Building location dictated by existing garage and large tree <br /> location. <br /> 3) . Property is near crest of large hill and safety issues dictate <br /> rearward location for traffic approach. <br /> 4) . Steps and stoops extend, furthest. <br /> 5) . Property is in an area of numerous nonconforming structures <br /> and many variances granted. <br /> CONCLUSION: <br /> 1) . Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. <br /> 2) . Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried - 4-0. <br /> #2555. Appeal by Town of Westport Utility District #1 for a <br /> Special Exception Permit as provided by Section 11. 05 (3) to permit <br /> filling, grading, etc. , within 300 feet of Lake Mendota in the NE <br /> 1/4 SE 1/4 - Section 5 South, Town of Westport. <br /> IN FAVOR: S. Anderson OPPOSED: --- COMMUNICATION: Town Board <br /> Dreps/Klopp to hold request until October Hearing to allow <br /> preparation of Winter stabilization plan. Motion carried - 4-0. <br /> 41r, <br />
