Appeal by Larry Gjerseth for a variance from required <br /> setback from road as provided by Section 10. 17 (3) to permit <br /> construction of single family residence at 3426 Quam Drive - being <br /> part of Lot #21, Addition to Ole J. Quam's Park and adjacent lands <br /> in the W1/2 SW1/4, Section 25, Town of Dunn. <br /> IN FAVOR: L. Gjerseth OPPOSED: -- COMMUNICATION: Town Board, <br /> Patrino, Christianson. <br /> Dreps\Gaskill to grant variance of 1. 2 feet from required setback <br /> from road to permit construction of new residence as proposed. <br /> FINDING OF FACT: <br /> 1) . Applicant has amended request for variance from 10 feet down <br /> to 1. 2 feet by reducing size of residence. <br /> 2) . Public sewer easement dictates smaller residence. <br /> 3) . Road was formerly substandard and required 20 foot minimum <br /> setback, however right-of-way acquisition changed road status to 30 <br /> foot required setback. <br /> CONCLUSION: <br /> 1) . Variance is not contrary to rights of others or to the public <br /> interest. <br /> 2) . Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. <br /> Motion carried - 4-0. <br /> #2557. Appeal by Dawn and William Cherek for a variance from <br /> required setback from road, sideyards and setback from normal high <br /> watermark as provided by Sections 10. 17 (5) , 10. 16 and 11. 03 (2) to <br /> permit deck and storage building as constructed at 4214 Morris Park <br /> Road - being Lot #15 and part Lot #16, Morris Park - Section 9, <br /> Town of Dunn. <br /> IN FAVOR: B & D Cherek OPPOSED: --- COMMUNICATION: Town <br /> Board. <br /> Dreps\Rlopp to grant variance of 51± feet from required setback to <br /> normal high watermark to permit deck to extend no further than 12 <br /> feet lakeside from existing residence, also to grant with condition <br /> variance of 23± feet from required setback to right-of-way of <br /> Morris Park Road to permit storage building as located and to deny <br /> variance from required right sideyard for deck addition as <br /> constructed. <br /> CONDITION: <br /> 1) . Storage shed to be removed if a garage is to be constructed. <br /> FINDING OF FACT: <br /> 1) . Deck expanded and replaced without required zoning permit. <br /> 2) . Storage shed constructed without required zoning permit. <br /> 3) . Existing residence sits askew on small restrictive lot. <br /> 4) . Reduced deck size is consistant with others receiving <br /> variances from normal high watermark. <br /> 5) . 5 foot minimum sideyard required on both sides. <br />
