Variance is not contrary to rights of others or to the public <br /> interest. <br /> 2) . Variance is necessary to provide right enjoyed by others. <br /> 3) . Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. <br /> Motion carried - 4-0 <br /> #2558 . Appeal by Kevin & Wendy Reilly for a variance from required <br /> setback from normal high watermark as provided by Section 11. 03 (2) <br /> to permit wood deck additions to single family residence at 4220 <br /> Morris Park - being Lots 10 and 11, Morris Park - Section 8, Town <br /> of Dunn. <br /> IN FAVOR: W & K Reilly OPPOSED: --- COMMUNICATION: Town <br /> Board <br /> Gaskill/Dreps to grant variance of 26± feet from required setback <br /> to normal high watermark to permit deck as constructed to right <br /> side of resdience. Also, to deny variance from normal high <br /> watermark to permit deck as constructed to left lakeside of <br /> existing residence. <br /> FINDING OF FACT: <br /> 1) . Both deck additions were constructed without necessary zoning <br /> permits. <br /> 2) . Deck addition to right side continues existing building line <br /> of residence while left side deck encroaches 12 . 5 feet nearer to <br /> normal high watermark. <br /> 3) . Left side deck is only slightly above grade and applicant has <br /> alternative means to accomplish desired entry. <br /> CONCLUSION: <br /> RIGHT SIDE: 1) . Variance preserves the zoning ordinance as much <br /> as possible without injustice to applicant. 2) . Variance is <br /> necessary to provide right enjoyed by others. <br /> LEFT SIDE: 1) . Unnecessary hardship was not proven. <br /> Motion carried - 4-0. <br /> #2559. Appeal by Michael Bertelsen for a variance from required <br /> sideyard as provided by Section 10. 16 (6) to permit accessory <br /> building as constructed at 4214 Windsor Road in the SW 1/4 NW 1/4 - <br /> Section 28, Town of Windsor. <br /> IN FAVOR: M. Bertelsen OPPOSED: --- COMMUNICATION: Town <br /> Board <br /> GASKILL/KLOPP to grant with condition variance of 2 ' 8" from <br /> required right sideyard to permit accessory building as <br /> constructed. <br />
