Slight movement of structure to complying location could <br /> utilize majority of foundation. <br /> 3. Applicant has large lot on which to site structure and <br /> complying location appears highly achievable. <br /> 4. Property is in an area of numerous non-conforming structures. <br /> CONCLUSION: <br /> 1. Unnecessary hardship was not proven. <br /> Motion carried 4-0. <br /> #2535. Appeal by Allen & Sandra Levin for a Special Exception <br /> Permit as provided by Section 11. 05 (3) to permit filling, grading, <br /> etc. , within 300 feet of Lake Mendota at 4585 Fox Bluff Lane being <br /> Lot #2, CSM 6937 in the N 1/2 SW 1/4 Section 5 South, Town of <br /> Westport. <br /> IN FAVOR: G. Brink OPPOSED: --- COMMUNICATION: Town Board <br /> Dreps/Gaskill to grant, with conditions, permit to fill and grade <br /> after razing old residence and landscaping after construction of <br /> new residence as proposed. <br /> CONDITIONS: <br /> 1. That plans and specifications be prepared by a licensed <br /> engineer within the scope of the application, and filed with the <br /> Zoning Department before commencement of any work. <br /> 2 . That all work be performed in compliance with approved <br /> engineering standards and all applicable governmental rules and <br /> regulations particularly Sec. 11. 05 (4) of DCO. <br /> 3 . That there be filed with the Zoning Department a certificate of <br /> compliance by a licensed engineer at the completion of the project. <br /> 4 . Inspection and approval by Zoning Department upon completion of <br /> project. <br /> 5. Applicant complete easement agreement with Sanitary District. <br /> 6. Completion and certification deadline of September 1, 1994 . <br /> FINDING OF FACT: <br /> 1. Proposal is to raze existing residence, fill-in foundation and <br /> re-contour for drainage. <br /> 2 . Driveway relocation is required to access new residence <br /> location. <br /> 3 . Property has received numerous Special Exception Permits <br /> previously. <br /> 4. Engineering data provided by Richard H. Severn, P.E. <br /> CONCLUSION: <br /> 1. The project as planned with specified conditions will not <br /> result in substantial detriment to navigable waters by erosion, <br /> sedimentation, impairment of fish or aquatic life, or safe and <br /> healthful conditions. <br /> Motion carried 4-0. <br />
