BOA MINUTES 11/20/97 <br /> Page 5 <br /> IN FAVOR: D. Holcomb OPPOSED: --- COMMUNICATION: <br /> Norbert Scribner. <br /> ROSS/KLOPP to grant variance of 32 . 96 feet from required 100 <br /> foot minimum lot width also, grant variance of 6622 square <br /> feet from required 15, 000 square foot minimum lot area to <br /> permit adjusting lot lines by certified survey map. <br /> Finding of Fact: <br /> 1) . Applicant had residence constructed, on (2) 33 foot <br /> lots, in violation of 10 foot minimum required sideyard. <br /> 2) . Applicant was denied a left sideyard variance August <br /> 22, 1996 (Appeal #2764) as unnecessary hardship was not <br /> proven. <br /> 3) . Variances as requested will allow land transfer with <br /> adjoining owner that will negate sideyard encroachment. <br /> 4) . Property is in a non-conforming plat (Edgerton Beach <br /> Park) and any lot line adjustment must be done by C.S.M. <br /> Conclusion: <br /> 1) . Variance preserves the zoning ordinance as much as <br /> possible without injustice to applicant. <br /> 2) . Variance is not contrary to rights of others or to the <br /> public interest. Motion carried - 5-0 . <br /> REQUEST RE-CONSIDERATION/CLARIFICATION: <br /> #2879. - Schmidt - Mazomanie - 10/23/97 P.H. <br /> No Appearances. <br /> KLUESNER/ROSS to consider at December Hearing. Motion <br /> carried - 5-0 . <br /> APPEALS FROM PREVIOUS HEARINGS: <br /> #2882 . Weber - Medina - 10/23/97 P.H. <br /> IN FAVOR: B. Weber <br /> HAMRE/KLOPP to grant variance of 2 feet from required <br /> setback to centerline of STH 19 to permit residence as <br /> constructed. <br /> Finding of Fact: <br /> 1) . Applicant constructed new home on vacant lot and <br /> violated required centerline setback on STH 19. <br /> 2) . Residence sits askew on lot and portion of garage <br /> encroaches 2 feet into required setback at furthest point. <br /> 3) . STH 19 is scheduled for future expansion and Department <br /> of Transportation has indicated they would be acquiring <br /> lands away from this property. <br /> 4) . This property adjoins a cemetery and right-of-way <br /> acquisition on South side STH 19 would require cemetery <br /> relocation. <br /> Conclusion: <br /> 1) . Variance preserves the zoning ordinance as much as <br /> possible without injustice to applicant. <br />
