The project as planned, with specified conditions; will <br /> tor not result in substantial detriment to navigable waters by <br /> erosion, sedimentation, impairment of fish or aquatic life, <br /> or safe and healthful conditions . Motion carried 4-0 . <br /> #2895. Appeal by Alan and Gloria Burke for a variance from <br /> required sideyard as provided by Section 10 . 13 (6) to permit <br /> storage building as constructed at 2008 Fish Hatchery Road <br /> being Lot #2, CSM 4901, in the NE 1/4 NE 1/4 - Section 34, <br /> Town of Madison. <br /> IN FAVOR: W. Jenkins OPPOSED: --- COMMUNICATION: Town <br /> Board, County Highway <br /> HAMRE/KLUESNER to grant variance of 0. 7 feet from required <br /> sideyards to permit accessory building as constructed. <br /> Finding of Fact: <br /> 1) . Zoning Permit (ZP 96-2170) was issued for an accessory <br /> building for maintenance equipment storage. <br /> 2) . Commercial (C-1) District requires 10 foot minimum side <br /> and rearyards . <br /> 3) . Applicant was able to locate property stakes and build <br /> off of subsequent survey disclosed one stake set in error. <br /> 4) . Heating and cooling units extend further into required <br /> yard. <br /> 5) . Property is in an area of numerous non-conforming <br /> structures with numerous variances being granted. <br /> 6) . Buildable area limited due to parking stalls required <br /> versus lot area available . <br /> Conclusion: <br /> 1) . Variance preserves the zoning ordinance as much as <br /> possible without injustice to applicant . <br /> 2) . Variance is not contrary to rights of others or to the <br /> public interest . Motion carried - 4-0 . <br /> #2896. Appeal by Town of Windsor for a Special Exception <br /> Permit as provided by Section 11 . 05 (3) to permit filling, <br /> grading, etc. , within 300 feet of the Yahara River located <br /> Northeast of 4589 Linden Circle in the SW 1/4 NE 1/4 - <br /> Section 31, Town of Windsor. <br /> IN FAVOR: M. Von Drasek OPPOSED: --- COMMUNICATION: - <br /> KLOPP/KLUESNER to grant, with conditions, permit to fill, <br /> grade and culvert installation as proposed. <br /> Conditions : <br /> 1) . That plans and specifications be prepared by a licensed <br /> engineer within the scope of the application, and filed with <br /> the Zoning Department before commencement of any work. <br /> 2) . That all work be performed in compliance with approved <br /> engineering standards and all applicable governmental rules <br />
