Existing residence is nonconforming as to setback from normal high <br /> watermark and sideyard as constructed. <br /> 2). Deck encroachment is minimal at only 6 feet towards normal high watermark. <br /> 3). Property is in an area of non-conforming structures with numerous similar <br /> variances granted. <br /> CONCLUSION: <br /> 1). Variance is not contrary to rights of others or to the public interest. <br /> 2). The structure shall be removed at the owner's expense if future road <br /> improvement requires additional right-of-way. <br /> FINDING OF FACT: <br /> 1). Applicant was issued, in error, a zoning permit to construct building <br /> where located. <br /> 2). Applicant's testimony is that road vacation is possible. <br /> 3). Pollow Road is little used access serving 2 properties. <br /> CONCLUSION: <br /> 1). Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> 2).
