Storey OPPOSED: --- COMMUNICATION: Town Board, Department <br /> of Natural Resources. <br /> Quackenbush/Edgar to hold in abeyance requested sideyard variance pending <br /> resolution of Land Division questions, abeyance not beyond February Hearing. <br /> Motion carried - 5-0. <br /> Edgar/Clark-Gaskill to grant variance of 5.75 more or less feet from required <br /> average setback to normal high watermark to permit residential addition as <br /> constructed. Variance is not intended to include additional proposed deck. <br /> FINDING OF FACT: <br /> 1). Zoning permit was issued for constructed addition based of erroneous <br /> information provided by owner. <br /> 2). Sunroom addition replaced former porch which was in need of repair. <br /> 3). With sunroom and covered deck need for additional open deck not show. <br /> 4). Property is in an area of numerous nonconforming structures with <br /> variances granted. <br /> CONCLUSION: <br /> 1). Variance is not contrary to rights of others or to the public interest. <br /> 2). Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> Motion carried - 5-0. <br /> #2205. Appeal by Richard & Beverly Klade for a variance from required maximum <br /> height of accessory building as provided by Sections 10.01(8) and 10.06(3) to <br /> permit expand and reconstruction of accessory building at 948 USH 51 E in the <br /> SE 1/4 SW 1/4 - Section 4, Town of Dunkirk. <br /> IN FAVOR: R. Klade OPPOSED: --- COMMUNICATION: --- <br /> Edgar/Quackenbush to deny requested variance from maximum height of accessory <br /> buildings to permit structure as proposed. <br /> FINDING OF FACT: <br /> 1). Structure is intended to replace an existing carriage house in need of <br /> repair. <br /> 2). A rezone of property could provide requested height without need for <br /> variance. <br /> 3). Applicant desires to maintain authenticity of "Turn of the Century <br /> Structure" in new construction. <br /> CONCLUSION: <br /> 1). Unnecessary hardship was not proven. <br /> Motion carried - 5-0. <br /> #2206.
