Appeal by James Wing, agent for Sandra Wing for a variance from <br /> required sideyard as provided by Section 10.16(6)(a) to permit accessory <br /> building as constructed at 2489 Thatcher Lane being Lot #33, Burmester Woods <br /> Plat - Section 16, Town of Dunn. <br /> IN FAVOR: J & S Wing, L. Gander OPPOSED: --- COMMUNICATION: Town Board <br /> Clark-Gaskill/Edgar to deny requested variance from minimum required sideyard <br /> to allow accessory building as constructed. <br /> FINDING OF FACT: <br /> 1). Structure erected without necessary permits. <br /> 2). Permit obtained showing structure in complying location - structure never <br /> moved. <br /> 3). Applicant has Large lot with little restriction as to location. <br /> CONCLUSION: <br /> 1). Unnecessary hardship was not proven. <br /> Motion carried - 5-0. <br /> #2208. Appeal by Vick and Mary Ann Miller for a variance from required <br /> setback from road as provided by Section 10.17(5) to permit entry addition as <br /> constructed at 4219 Brian Street being Lot # 37, - Spartan Hills Plat - <br /> Section 9, Town of Dunn. <br /> IN FAVOR: M & V Miller, M. Wick, M. Sloniker OPPOSED: --- <br /> COMMUNICATION: Town Board. <br /> Quackenbush/Edgar to grant variance of 7.5 more or les feet to required <br /> setback to right-of-way of Brian Street to permit deck/entryway as constructed. <br /> FINDING OF FACT: <br /> 1). Structure constructed under Permit (ZP 89 1928) which was issued based on <br /> erroneous site plan provided by builder. <br /> 2). Entry covers over a deteriorating concrete stoop in need of repair. <br /> 3). Uncovered entry offers a minimal incursion into required setback. <br /> CONCLUSION: <br /> 1). Variance is not contrary to rights of others or the the public interest. <br /> 2). Variance is necessary to provide right enjoyed by others. <br /> Motion carried - 5-0. <br /> #2210. Appeal by Annette Marie Byrnes for a variance from required sideyard <br /> as provided by Section 10.06(7) to permit addition to existing single family <br /> ILY residence and garage at 2413 Badger Lane - in the SW 1/4 NE 1/4 - Section 36, <br /> Town of Madison. <br />
