MINUTES OF THE MEETING OF THE DANE COUNTY <br /> BOARD OF ADJUSTMENT <br /> COMMITTEE HELD ON October 24, 1991 <br /> The following members were present: Edgar, Rendall, Harvey, Quackenbush and <br /> Clark Gaskill. <br /> Also: Fleck, Reynolds, Webster and Schiffer. <br /> Meeting called to order at 7:00 P.M. by Chairman Harvey in Room 2E City-County <br /> Building as published by Class II Notice. <br /> Rendall/Edgar to amend minutes of September 26, 1991 to read meeting adjourned <br /> at 3:20 A.M. - approve minutes of October 22, 1991 and September 26, 1991 as <br /> amended. Motion carried - 5-0. <br /> #2182. Appeal by Douglas & Connie Powers for a variance from required maximum <br /> height and square footage of accessory building and sideyard as provided by <br /> Sections 10.07(3), 10.04(1) and 10.07(7) to permit accessory building as <br /> constructed at 2166 Colladay Point Drive being Lot #24, Colladay's Point <br /> Section 23, Town of Dunn. <br /> IN FAVOR: D. Powers, M. Skindrud OPPOSED: --- COMMUNICATION: Town Board <br /> and petition by 3 neighbors <br /> Quackenbush/Clark-Gaskill to grant, with condition, variance of 6 more or less <br /> feet from required right sideyard to permit garage as constructed after <br /> attaching structure to residence by means of breezeway. <br /> CONDITIONS: <br /> 1). Approval as per G.M.K. Architecture plan dated 10/24/91. <br /> 2). Attaching structure (breezeway) to be constructed with 60 days from <br /> approval. <br /> Motion carried - 5-0. <br /> Quackenbush/Edgar to hold in abeyance, not beyond January 1992 Hearing, <br /> request for variance from maximum height of accessory building and square <br /> footage of accessory building versus residence. Motion carried - 5-0. <br /> FINDING OF FACT: <br /> 1). Prospective purchaser has an accepted offer to purchase, subject to <br /> remedy of Zoning Violations. <br /> 2). Intent is to attach accessory building to residence thus relieving height <br /> and square footage violations. <br /> 3). Garage addition constructed under Permit ZP 1990 1682 in violation of <br /> Ordinance requirements. <br /> 4). Applicant has 90 day abeyance of height and square footage variance, if <br /> attaching structure (breezeway) not constructed than violations can be <br /> addressed. <br /> CONCLUSION: <br /> 1). Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> 2). Variance is not contrary to rights of others or to the public interest. <br /> #2183. Appeal by Ray Buckeridge for a Special Exception Permit as provided by <br /> Section 11.05(3) to permit filling, grading, etc. , within 300 feet of Marsh <br /> Creek at 6147 Beckman Road in the SW 1/4 SE 1/4 - Section 6, Town of Mazomanie. <br />
