Motion carried - 5-0. <br /> 0 <br /> #2184. Appeal by Ken Schubert for a variance from required maximum height of <br /> accessory building as provided by Sections 10.05(3) and 11.03(3) to permit <br /> construction of 2 story boathouse at 4609 Fox Bluff Lane being Lot 1, CSM 6004 <br /> - Section 5 So., Town of Westport. <br /> IN FAVOR: K. Schubert, B. Van DeWalle, J. Pohlman OPPOSED: B. Keuhling <br /> COMMUNICATION: Department of Natural Resources, Town Board, letters from (3) <br /> neighbors. <br /> Clark-Gaskill/Quackenbush to deny requested variance from maximum height of <br /> accessory building to permit boathouse as proposed. <br /> FINDING OF FACT: <br /> 1). Applicant proposes large boathouse with 2nd story storage area atop. <br /> 2). Applicant desires boathouse on portion of lot which has steep embankment <br /> versus flatter portion of lot. <br /> 3). Lot on which boathouse to be located is presently without residence. <br /> CONCLUSION: <br /> 1). Unnecessary hardship was not proven. <br /> Motion carried - 5-0. <br /> #2185. Appeal by Bert & Joan Bailey for a variance from required sideyard as <br /> provided by Sections 10.07(7) and 10.16(5) to permit carport addition to <br /> existing residence at 309 Powers Avenue being Lot #6, Block #9, Second <br /> Addition to E.L. Gallagher Subdivision - Section 5, Town of Blooming Grove. <br /> IN FAVOR: J. Bailey, M. Huffman OPPOSED: --- COMMUNICATION: Petition <br /> from (3) neighbors. <br /> Quackenbush/Edgar to grant, with conditions, variance of 4 feet from required <br /> right sideyard to permit construction of carport. <br /> CONDITIONS: <br /> 1) . Supporting posts constructed not nearer than 1 foot to lot line and roof <br /> overhang with required eave troughs not to extend over lot line. <br /> 2). Sidewalls on 3 exposed sides not to_be enclosed by other than a temporary <br /> plastic type material. <br /> FINDING OF FACT: <br /> 1). Lot width is 40 feet while existing residence is 26 feet wide. <br /> 2). Large tree located in rear yard prohibits construction of garage behind <br /> residence. <br /> 3). Property is in an area of numerous non-conforming structures with similar <br /> structures constructed. <br /> CONCLUSION: <br /> 1). Variance is not contrary to rights of others or to the public interest. <br /> 2). Variance is necessary to provide right enjoyed by others. <br /> Motion carried - 5-0. <br />
