MINUTES OF THE MEETING OF THE DANE COUNTY <br /> BOARD OF ADJUSTMENT <br /> 11Cur COMMITTEE HELD ON August 22, 1991 <br /> The following members were present: Rendall, Harvey, Arts and Quackenbush. <br /> Also: Reynolds. <br /> Meeting called to order by Chairman Harvey at 7:00 P.M. in Room 2E City-County <br /> Building to hold public hearing as published by Class II Notice. <br /> Rendall/Arts to amend minutes of July 25, 1991 Re: Appeal #2145 decision to <br /> read: ---- to permit residence to extend 3 feet nearer to right-of-way than <br /> already exists. Motion carried - 3-0. <br /> Rendall/Arts to approve minutes of July 25, 1991 as amended and minutes of <br /> 8/20/91. Motion carried - 3-0. <br /> #2153. Appeal by Michael J. Smith for a variance from required setback from <br /> road as provided by Section 10.17(3)(b) to permit addition to existing single <br /> family residence at 4054 Moe Road in the SW 1/4 SW 1/4 - Section 14, Town of <br /> Vermont. <br /> IN FAVOR: M. Smith OPPOSED: --- COMMUNICATION: Town Board. <br /> Arts/Rendall to grant variance of 26 feet from required setback to centerline <br /> of Moe Road to permit addition to existing residence as proposed. <br /> FINDING OF FACT: <br /> 1). Existing residence extends nearer to required setback than will proposed <br /> 411, addition. <br /> 2). Applicant has a Variance (#1167) from 1983 for a new basement under <br /> existing residence. <br /> 3). Existing residence is approximately 100 years old. <br /> CONCLUSION: <br /> 1). Variance is not contrary to rights of others or to the public interest. <br /> 2). Hardship is caused by the ordinance and is not self-imposed. <br /> Motion carried - 3-0. <br /> #2154. Knox - Dunn. <br /> Applicant has withdrawn the Appeal. <br /> #2155. Appeal by Dean Sippola for a variance from required setback from road <br /> and rearyard as provided by Sections 10.17(2)(b) & 10.07(8) to permit <br /> construction of accessory building at 10731 CTH Y in the SE 1/4 NW 1/4 - <br /> Section 33, Town of Mazomanie. <br /> IN FAVOR: D. Sippola OPPOSED: _-= COMMUNICATION: County Highway, Town <br /> Board. <br /> Harvey/Arts to grant, with condition, variance of 8 feet more or less from <br /> required setback to right-of-way of CTH Y. Also, variance of 14.2 feet more <br /> or less from required rearyard to permit construction of residential garage. <br /> CONDITION: <br /> 1). The structure shall be removed at the owners expense if future road <br /> improvement requires additional right-of-way and there be a demonstrated need <br /> for its removal. <br /> tor <br />
