BOA MINUTES/8/22/91 <br /> Page 2 <br /> FINDING OF FACT: <br /> 1). Proposed structure will encroach into required setback and rearyard no <br /> more than does existing residence. <br /> 2). Applicant presently is without a garage for vehicle storage. <br /> 3). Variances granted to permit lot creation by CSM for existing residence. <br /> 4). Similar Variance granted on adjoining lot for similar structure. <br /> CONCLUSION: <br /> 1). Variance is necessary to provide right enjoyed by others. <br /> 2). Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> Motion carried - 3-0. <br /> #2156. Appeal by James & Janet Spencer for a variance from required distance <br /> of barn from residential zoned property as provided by Section 10.123(7)(b) to <br /> permit continued use of Ag-building after rezoning at 2407 USH 12-18 in the NE <br /> 1/4 SE 1/4 - Section 33, Town of Cottage Grove. <br /> IN FAVOR: J. Spencer OPPOSED: --- COMMUNICATION: --- <br /> Rendall/Harvey to grant variance of 34 feet more or less from required <br /> distance an ag building is required to be from residential district. <br /> FINDING OF FACT: <br /> 1). Property was existing farm and residence was rezoned to permit duplex use <br /> of existing residence. <br /> 2). Location of structures was already established, however rezoning <br /> necessitated Variance from same. <br /> 3). Present owner purchased land as exists approximately 1 year ago. <br /> CONCLUSION: <br /> 1). Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> 2). Variance is not contrary to rights of others or to the pubic interest. <br /> Motion carried - 3-0. <br /> #2157. Appeal by Thomas & Carla Noyce for a variance from required setback <br /> from road as provided by Section 10.17(5)(b) to permit entry addition to <br /> existing residence at 4402 Curry Lane being Lot #2, Blk. #3 1st Addition to <br /> Sunset Meadows - Section 29, Town of Windsor. <br /> IN FAVOR: T. That structure not be enclosed or utilized as living space. <br /> FINDING OF FACT: <br /> 1). Residence is in an area of numerous non-conforming structures constructed <br /> prior to zoning inspection. <br /> 2). Nearby residence has similar variance for garage addition. <br /> 3).
