Sign ordinance specifies sign may not exceed 50 feet above center line <br /> grade of adjoining highway and grade of property is 11 feet above said <br /> centerline. <br /> 2). Lot is large and commercially zoned and abuts Interstate 90-94. <br /> 3). Existing commercial building has multiple users who are dependent upon <br /> visibility to interstate truckers to earn livelihood. <br /> 4). New sign ordinance restrictions prohibit uses that were afforded to <br /> established businesses. <br /> CONCLUSION: <br /> 1). Variance preserves the zoning ordinance as much as possible without <br /> Cr injustice to applicant. <br /> 2). Opitz OPPOSED: --- <br /> COMMUNICATION: Town Board, Department of Natural Resources. <br /> Arts/Quackenbush to grant with condition variance of 4 feet from maximum <br /> height of boathouse above normal high watermark to permit construction of new <br /> boathouse as proposed. <br /> CONDITION: <br /> 1). That atop boathouse there shall be no railing, no decking or no deck <br /> usage. <br /> FINDING OF FACT: <br /> 1). Boathouse is to be constructed at 12 feet in height, however grade at <br /> requested setback is 4 feet above normal high watermark. <br /> 2). Applicant proposes 10 foot setback from normal high watermark in order to <br /> maintain natural shoreline asthetics and to prevent structural damage due to <br /> ice heave. <br /> 3). Applicant proposes a track-system to dolly boats inside. <br /> 4). 12 foot height is needed to accommodate owners watercraft. <br /> 5). At 10 foot setback from normal high watermark a minimal amount of <br /> disturbance to trees and shoreland vegetation. <br /> Limw CONCLUSION: <br /> 1).
