BOA Minutes/8/22/91 <br /> Page 4 <br /> 2). Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> Motion carried - 4-0. <br /> #2160. Appeal by Jeff & Joni Sayers for a Special Exception Permit as <br /> provided by Section 11.05(3) to permit filling, grading, etc., within 300 feet <br /> of Lake Waubesa at 2779 Tower Road being Lot #16, Blk. #1, Greenridge Park - <br /> Section 9, Town of Dunn. <br /> IN FAVOR: J. Sayers OPPOSED: --- COMMUNICATION: Town Board <br /> Quackenbush/Arts to grant, with conditions, permit to fill/grade in <br /> conjunction with construction of basement walkout/entry from existing <br /> residence. <br /> CONDITIONS: <br /> 1). Approved as per size and plans submitted. <br /> 2). That plans and specifications be prepared by a licensed engineer within <br /> the scope of the application, and filed with the Zoning Department before <br /> commencement of any work. <br /> 3). That all work be performed in compliance with approved engineering <br /> standards and all applicable governmental rules and regulations particularly <br /> Section 11.05(4) of Dane County Ordinance. <br /> 4). That there be filed with the Zoning Department a certificate of <br /> compliance by a licensed engineer at the completion of the project. <br /> 5). Permit valid for 90 days from approval. <br /> 6). The applicant shall request inspection by the Dane County Zoning <br /> Department upon completion of the project. <br /> FINDING OF FACT: <br /> 1). Applicant already has existing basement walk-out which is in need of <br /> repair. <br /> 2). Proposal is to widen existing walkout at the same time relocating further <br /> from normal high watermark. <br /> 3). Deck over walk-out has been removed. <br /> 4). The plans include adding steps to alleviate slippery ramp that freezes <br /> over in winter. <br /> CONCLUSION: <br /> The project as planned, with specified conditions; will not result in <br /> substantial detriment to navigable waters by erosion, sedimentation, <br /> impairment of fish or aquatic life, or safe and healthful conditions. <br /> Motion carried - 4-0. <br /> #2161. Appeal by David Everett, agent for John Weber for Special Exception <br /> Permit as provided by Section 11.05(3) to permit filling, grading, etc. , <br /> within 300 feet of Lake Kegonsa also for a variance from required setback to <br /> normal high waterline as provided by Section 11.03(2) to permit deck <br /> enlargement at 2224 Colladay Point Drive being Lot #1, Harriet Colladay <br /> Subdivision - Section 23, Town of Dunn. <br /> IN FAVOR D. Everett, J. Weber OPPOSED: --- COMMUNICATION: Town Board, <br /> Department of Natural Resources <br /> Quackenbush/Arts to hold variance and Special Exception Permit pending <br /> submittal of engineering detail and possibility of lessening disturbed area. <br /> Motion carried - 4-0. <br />
