Hartwig for a variance from required setback from <br /> normal high watermark as provided by Section 11.03(2) to permit addition to <br /> existing residence at 2996 Waubesa Avenue being Lot #18, Block 1, Waubesa <br /> Beach - Section 5, Town of Dunn. <br /> IN FAVOR: D. Hartwig, S. Zimmerman, M. Gravel OPPOSED: --- <br /> COMMUNICATION: Town Board, Department of Natural Resources. <br /> Quackenbush/Arts to hold request in abeyance until September Hearing to permit <br /> applicant to seek alternate plans to reduce amount of variance requested. <br /> Motion carried - 4-0. <br /> #2163. Appeal by Allen Jacobs for a Special Exception Permit as provided by <br /> Section 11.05(3) to permit filling, grading, etc. , within 300 feet of Lake <br /> Kegonsa at 2182 Colladay Point Drive being Lot #17, Colladay Point Subdivision <br /> - Section 23, Town of Dunn. <br /> IN FAVOR: A. Jacobs OPPOSED: --- COMMUNICATION: Town Board <br /> Arts/Quackenbush to grant, with conditions, permit to fill/grade and retaining <br /> wall as proposed. <br /> CONDITIONS: <br /> 1). That plans and specifications be prepared by a licensed engineer within <br /> the scope of the application, and filed with the Zoning Department before <br /> commencement of any work. <br /> 2). That all work be performed in compliance with approved engineering <br /> standards and all applicable governmental rules and regulations particularly <br /> Section 11.05(4) of Dane County Ordinance. <br /> 3). That there be filed with the Zoning Department a certificate of <br /> compliance by a licensed engineer at the completion of the project. <br /> 4). That prior to commencing earth disturbing activity, therefore on file <br /> with Dane County Zoning a Soil Erosion Plan. <br /> 5). Earth disturbing activity has a 60 day completion deadline. <br /> FINDING OF FACT: <br /> 1). Applicant proposes no substantial contour changes only small stone <br /> retaining wall atop of bank and rock garden and plantings around residence. <br /> 2). Project is in conjunction with new home construction. <br /> 3). Walk-way, seeding and landscape contouring to be done immediately while <br /> some plantings continuing until spring. <br /> CONCLUSION: <br /> 1). The project as planned, with specified conditions; will not result in <br /> substantial detriment to navigable waters by erosion, sedimentation, <br /> impairment of fish or aquatic life, or safe and healthful conditions. <br /> Motion carried - 4-0. <br /> #2164. Appeal by David Moyer, agent for Richard J. Wojtas for a Special <br /> Exception Permit as provided by Section 11.05(3) to permit filling, grading, <br /> etc., within 300 feet of Lake Kegonsa at 2259 Williams Point Drive being Lot <br /> #20, Williams Point Section 19, Town of Pleasant Springs. <br /> IN FAVOR: D. Moyer OPPOSED: --- COMMUNICATION: Town Board. <br /> Arts/Quackenbush to grant, with conditions, permit to fill/grade low lying <br /> areas of lot to prevent ponding of water. <br /> L <br />
