BOA Minutes/8/22/91 <br /> Page 6 <br /> CONDITIONS: <br /> 1). That plans and specifications be prepared by a licensed engineer within <br /> the scope of the application, and filed with the Zoning Department before <br /> commencement of any work. <br /> 2). That all work be performed in compliance with approved engineering <br /> standards and all applicable governmental rules and regulations particularly <br /> Section 11.05(4) of Dane County Ordinance. <br /> 3). That there be filed with the Zoning Department a certificate of <br /> compliance by a licensed engineer at the completion of the project. <br /> FINDING OF FACT: <br /> 1). Property, as adjoining lots, is virtually flat with the exception of low <br /> areas which hold water. <br /> 2). Residential construction covers fill and backfill around residence. <br /> 3). Applicant proposes to restore only natural grade and re-seed. <br /> CONCLUSION: <br /> The project as planned, with specified conditions; will not result in <br /> substantial detriment to navigable waters by erosion, sedimentation, <br /> impairment of fish or aquatic life, or safe and healthful conditions. <br /> Motion carried - 4-0. <br /> #2165. Appeal by David Everett, agent for Fred Kipp for a variance from <br /> required sideyard as provided by Section 10.07(7) to permit deck addition to <br /> existing residence at 2039 Skyline Drive at 2039 Skyline Drive being Lot #3, <br /> 1st Addition Kegonsa Grove - Section 29, Town of Pleasant Springs. <br /> IN FAVOR: D. Everett OPPOSED: --- COMMUNICATION: --- <br /> Arts/Quackenbush to grant variance of 2.1 more or less feet from required left <br /> sideyard to permit deck addition to exist residence to encroach no nearer to <br /> adjoining property than residence. <br /> FINDING OF FACT: <br /> 1). Variance #2089 granted 1/24/91 to permit residential addition to be <br /> constructed within 7' 11" of the left sideyard. <br /> 2). Variance #2089 and zoning permit indicated proposed deck was to be at <br /> grade patio - applicant now wishes deck. <br /> 3). 2 Existing doors 1.5 feet to 2 feet above grade will exit onto proposed <br /> deck. <br /> 4). Deck structure will not become covered nor enclosed. <br /> CONCLUSION: <br /> 1). Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> 2). Variance is necessary to provide right enjoyed by others. <br /> Motion carried - 4-0. _. <br /> #2166. Appeal by Robert Kuhl for a variance from required setback from road <br /> as provided by Section 10.17(3) to permit replacing storm damaged accessory <br /> building at 5260 Tower Line Road in the NW 1/4 NE 1/4 - Section 26, Town of <br /> Medina. <br /> C <br />
