Appeal by Daniel and Terry Nonn for a variance from required setback <br /> from road as provided by Section 10.17(2) to permit single family residence as <br /> constructed at 5371 CTH P in the NW 1/4 SW 1/4 Section 19, Town of <br /> Springfield. <br /> IN FAVOR: D. Peterson, D. Ripp OPPOSED: --- <br /> COMMUNICATION: Town Board, <br /> County Highway, Norbert Scribner. <br /> Quackenbush/Edgar to grant, with condition, variance of 10.13 feet from <br /> required setback from right-of-way of CTH P to permit residence as constructed. <br /> CONDITION: <br />• 1). The structure shall be removed at the owner's expense if future road <br /> improvement requires additional right-of-way. <br /> FINDING OF FACT: <br /> 1). Property has expanded right-of-way already taken by County Highway <br /> Department (80 feet of right-of-way in front of this property). <br /> 2). Buildable area of property is severly limited due to steep hill and <br /> drainage easement. <br /> 3). Structure location due to contractor error. <br /> 4). Dane County Highway Department has no objection, with condition as stated. <br /> CONCLUSION: <br /> 1). Variance is not contrary to rights of others or to the public interest. <br /> 2). Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> Motion carried - 4-0. (Rendall, absent). <br /> Clark-Gaskill/Harvey to adjourn.
