Thomas - Burke - 12/20/90 P.H. <br /> Continuation not beyond September Hearing. <br /> #2130. Schkirkie - Dunn - 5/23/91 P.H. <br /> Clark-Gaskill/Arts to hold in abeyance until August Hearing. <br /> Motion carried - 3-0. <br /> 0, #2132. Klarer - Perry - 6/27/91 P.H. <br /> Quackenbush/Arts to grant, with conditions, variance of 10 more or less feet <br /> from required setback to Clay Hill Road to permit replacing existing garage. <br /> CONDITION: <br /> 1). That new structure encroach into required setback no nearer than did <br /> existing garage. <br /> 2). The structure shall be removed at the owner's expense if future road <br /> improvement requires additional right-of-way. <br /> FINDING OF FACT: <br /> 1). Applicant is replacing existing garage with larger structure more suited <br /> to his needs. <br /> 2). Lot is smaller and bound by State Highway on one side and township road <br /> on another. <br /> 3). Questionable soils nad high bedrock limit location for replacement septic <br /> system. <br /> 4). Clay Hill Road is not a heavily traveled thoroughfare. <br /> CONCLUSION: <br /> 1). Variance is not contrary to rights of others or to the public interest. <br /> 2). Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> Motion carried - 3-0. <br /> #2140.
