The residence was constructed with a variance and no garage intended <br /> (Variance #366 - July 1975). <br /> 2). Property is only remaining residence on North side of South Road in the <br /> township. The adjoining properties all in Village of DeForest, and have the <br /> benefit of public sewer. <br /> 3). Applicant's wish to enchance property in order to accommodate sale. <br /> 4). Applicant's wish to utilize existing gravel drive and indicate <br /> unwillingness to seek modification or alternate plan. <br /> CONCLUSION: <br />► 1). Unnecessary hardship was not proven. <br /> Motion carried - 3-0. <br /> #2151 Appeal by T.L.C. Motion carried - 3-0. <br /> #2152 Appeal by Mark Gerhardt, Agent for Jack Way Builders, for a variance <br /> from required minimum lot width at building setback line as provided by <br /> Section 10.05(4)(a) to permit construction of single family residence at 2130 <br /> Native Place being Lot 32, American Heritage, Section 3, Town of Cottage Grove. <br /> IN FAVOR: G & B Wara OPPOSED: --- COMMUNICATION: --- <br /> Quackenbush/Arts to grant, with condition, variance of 23 more or less feet <br /> from required lot width at front building line of proposed residence. <br /> CONDITION: <br /> 1). That actual lot width to be determined by the setback from right-of-way <br /> of the proposed residence to be no closer than setback from right-of-way of <br /> existing residence as exists on Lot #31. <br /> FINDING OF FACT: <br /> 1). Lot is 38.6 feet wide at road right-of-way. <br /> 2). Residence would have to be setback from right-of-way 85 feet to achieve <br /> 100 feet of lot width at front building line. <br /> 3). Plat, American Heritage, was created prior to 100 foot lot width <br /> requirement. <br /> CONCLUSION: <br /> 1). Variance is necessary to provide right enjoyed by others. <br /> 2). Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> C <br />
