Hawkinson, agent for Harlow Hawkinson <br /> Estate for a variance from required setback from road and <br /> maximum allowable lot coverage as provided by Section <br /> 10. 17 (4) and 10 . 16 (5) to permit proposed garage addition <br /> to existing Single Family Residence at 3432 Mallard <br /> Avenue being the E 1/2 Lot 1, Rock Elm Park, Section 26, <br /> Town of Dunn. <br /> IN FAVOR: M. Hawkinson OPPOSED: --- COMMUNICATION: <br /> Town Board <br /> Gaskill/Klopp to grant, with condition, variance of 10 feet to <br /> required setback to right-of-way of Mallard Avenue - also, Variance <br /> of 303 . 6 square feet from maximum allowable lot coverage to permit <br /> construction of attached residential garage. <br /> CONDITION: That existing carport and existing storage shed be <br /> removed from the property. <br /> FINDING OF FACT: <br /> 1) . Lot is extremely small lake property with limited buildable <br /> area. <br /> 2) . Proposed addition will replace existing carport located less <br /> (irr than 2 feet from right-of-way line. <br /> 3) . Adjoining property has received similar Variances (#2021) . <br /> 4) . Proposed addition is modest sized garage which will continue <br /> existing building line. <br /> 5) . Mallard Avenue is an unimproved, little used road serving only <br /> a few residences . <br /> CONCLUSION: <br /> 1) . Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. <br /> 2) . Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried - 5-0 . <br /> OTHER BUSINESS: <br /> #2270 - Essert - Westport - 6/25/92 P. H. <br /> Dreps/Lynch to reconsider previous variance approval and amend to <br /> remove the words as constructed from decision granted on July 22 , <br /> 1993 . <br /> FINDING OF FACT: <br /> 1) . Existing structure is unable to pass building code <br /> requirements as constructed. <br /> 2) . Amendment will allow code complying structure to be built on <br /> footprint of existing beer garden. <br /> 3) . Condition stating "approval subject to approvals by all other <br /> necessary governmental agencies" remains in effect. <br />
