MINUTES OF THE MEETING OF THE DANE COUNTY <br /> (lbr <br /> BOARD OF ADJUSTMENT <br /> COMMITTEE HELD ON June 24, 1993 <br /> The following members were present: Gaskill , Klopp, Quackenbush, Lynch and <br /> Dreps. <br /> Also: Fleck and Reynolds. <br /> Meeting called to order by Chairman Quackenbush at 6:32 P.M. in Room #2E <br /> City-County Building to hold public hearing as published by Class II Notice. <br /> MINUTES: Gaskill/Dreps to approve minutes of April 15, April 25, may 27 and <br /> June 15. motion carried - 4-0. Lynch , abstain. <br /> APPEALS FROM PREVIOUS HEARINGS: <br /> #2389. Silverman - Dunn - 5/27/93 P.H. <br /> IN FAVOR: D. Silverman OPPOSED: --- COMMUNICATION: Town Board, <br /> Department of Natural Resources. <br /> Dreps/Gaskill to deny requested variances as proposed. <br /> Roll Call : Lynch - no, Dreps - Aye, Klopp - No, Gaskill - Aye and Quackenbush <br /> - No. Motion failed. <br /> Lynch/Klopp to grant lot coverage variance of 2.33% or 108 square feet to <br /> allow deck addition to existing residence. <br /> FINDING OF FACT: <br /> I ). Variance is specifically for a deck 12 feet wide and extending not more <br /> than 9 feet towards lake. <br /> 2). By reducing deck size variance from required setback to normal high water <br /> mark no longer needed. <br /> 3) . The 12 feet in width will equal size of existing patio doors. <br /> 4) . Applicant had to revise plan of proposed residence as not to exceed <br /> maximum permitted lot coverage. <br /> 5) . Property is in an area of numerous nonconforming structures to which <br /> numerous variances have been granted. <br /> CONCLUSION: <br /> I ). Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> 2). Variance is necessary to provide right enjoyed by others. <br /> Roll Call : Dreps - No, Klopp - Aye, Gaskill - No, Quackenbush - Aye and Lynch <br /> - Aye. Motion carried - 3-2. <br /> #2379. Gottsacker - Middleton - 4/22/93 (withdrawn by applicant. ) <br /> #2370. Bowen - Dunn - 4/22/93: <br /> Dreps/Lynch to grant reconsideration of previous approval and allow applicant <br /> to revise dimensions of proposed accessory building to reflect shortening <br /> structure to meet granted setback . Motion carried - 5-0. <br /> or <br /> #2359. Engen - Windsor - 3/25/93 P.H. <br /> Gaskill/Lynch to hold appeal in abeyance until July Hearing as per request of <br /> applicant. Motion carried - 5-0. <br />
