MINUTES OF THE MEETING OF THE DANE COUNTY (lbr BOARD OF ADJUSTMENT COMMITTEE HELD ON June 24, 1993 The following members were present: Gaskill , Klopp, Quackenbush, Lynch and Dreps. Also: Fleck and Reynolds. Meeting called to order by Chairman Quackenbush at 6:32 P.M. in Room #2E City-County Building to hold public hearing as published by Class II Notice. MINUTES: Gaskill/Dreps to approve minutes of April 15, April 25, may 27 and June 15. motion carried - 4-0. Lynch , abstain. APPEALS FROM PREVIOUS HEARINGS: #2389. Silverman - Dunn - 5/27/93 P.H. IN FAVOR: D. Silverman OPPOSED: --- COMMUNICATION: Town Board, Department of Natural Resources. Dreps/Gaskill to deny requested variances as proposed. Roll Call : Lynch - no, Dreps - Aye, Klopp - No, Gaskill - Aye and Quackenbush - No. Motion failed. Lynch/Klopp to grant lot coverage variance of 2.33% or 108 square feet to allow deck addition to existing residence. FINDING OF FACT: I ). Variance is specifically for a deck 12 feet wide and extending not more than 9 feet towards lake. 2). By reducing deck size variance from required setback to normal high water mark no longer needed. 3) . The 12 feet in width will equal size of existing patio doors. 4) . Applicant had to revise plan of proposed residence as not to exceed maximum permitted lot coverage. 5) . Property is in an area of numerous nonconforming structures to which numerous variances have been granted. CONCLUSION: I ). Variance preserves the zoning ordinance as much as possible without injustice to applicant. 2). Variance is necessary to provide right enjoyed by others. Roll Call : Dreps - No, Klopp - Aye, Gaskill - No, Quackenbush - Aye and Lynch - Aye. Motion carried - 3-2. #2379. Gottsacker - Middleton - 4/22/93 (withdrawn by applicant. ) #2370. Bowen - Dunn - 4/22/93: Dreps/Lynch to grant reconsideration of previous approval and allow applicant to revise dimensions of proposed accessory building to reflect shortening structure to meet granted setback . Motion carried - 5-0. or #2359. Engen - Windsor - 3/25/93 P.H. Gaskill/Lynch to hold appeal in abeyance until July Hearing as per request of applicant. Motion carried - 5-0.
