Appeal by Louis Breunig for a variance from required setback from road <br /> as provided by Section. 10.17(2) to permit addition to existing agricultural <br /> building at 8667 CTH Y in the SW 1/4 NW 1/4 - Section 22, Town of Roxbury. <br /> IN FAVOR: L. Breunig OPPOSED: --- COMMUNICATION: County Highway. <br /> Gaskill/Lynch to grant with condition variance of 13.5 feet from the required <br /> setback to centerline CTH V to permit 16' x 120 ' barn addition as proposed. <br /> CONDITION: <br /> The barn addition shall be removed at the owner's expense if future road <br /> improvement requires additional right-of-way. <br /> FINDING OF FACT: <br /> 1 ). Applicant has working dairy operation and addition is integral part of <br /> modernizing the operation. <br /> 2). Feed lot and other agricultural accessory buildings prohibit location <br /> addition elsewhere. <br /> 3) . Addition is to be free stall barn with feed bunks to accommodate winter <br /> feeding. <br /> 4) . Numerous other structures nearer or as near, this request, on same <br /> property or across road. <br /> 5). Dane County Highway Department anticipates no additional right-of-ways <br /> being acquired and with condition appears not to object. <br /> CONCLUSION: <br /> I ). Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> 2). Variance is not contrary to rights of others or to the public interest. <br /> Motion carried - 5-0. <br /> #2397. Heniadas OPPOSED: --- COMMUNICATION: --- <br /> Lynch/Dreps to grant variance of 2.25 feet from required left side yard to <br /> permit new foundation/basement under existing residence. <br /> FINDING OF FACT: <br /> I ). Sideyard encroachment will remain unchanged by adding basement area. <br /> 2) . Addition is to be utilized for residential living space expansion for <br /> growing family. <br />
