MINUTES OF THE MEETING OF THE DANE COUNTY <br /> BOARD OF ADJUSTMENT <br /> COMMITTEE HELD ON May 27, 1993 <br /> The following members were present: Gaskill , Klopp, Dreps and Quackenbush <br /> Also: Fleck, Gunderman and Reynolds. <br /> Meeting called to order by Chairman Quackenbush at 6:32 P.M. in Room 2E <br /> City-County Building to hold public hearing as published by Class II Notice. <br /> MINUTES: (4/22/93 - Gaskill/Dreps to amend minutes of #2362 to read.- <br /> Lynch/Dreps to hold appeal in abeyance until May Hearing - as per request of <br /> the township. <br /> Also, #2363 finding of fact to read: <br /> FINDING OF FACT: <br /> I ). Zoning permit was issued prior to Zoning Department making field <br /> inspections. <br /> 2). Site plan provided by permit issuance shows adequate yards. <br /> 3). Present owner was not responsible for building location. <br /> 4). Adjoining neighbor unwilling to sell needed lands. <br /> 5). Zoning Administrator acknowledged that legislation grandfathering such <br /> encroachment will be submitted in the near future. <br /> 6). Structure has stood for over 25 years, 10 of which were occupied by <br /> appellant, without presenting a problem as attested to by adjacent owner. <br /> Gaskill/Dreps to approve minutes as amended. Motion carried - 3-0. <br /> Appeals from previous hearings: <br /> a). #2270 - Essert - Westport - 6/25/92 <br /> Gaskill/Dreps to grant abeyance, as requested by appellant, not to exceed July <br /> Hearing. Motion carried - 3-0. <br /> *Board has directed staff to notify appellant that this request will be dealt <br /> with at July Hearing, with no further stays. <br /> #2290. Weber - Dunn - 8/27/92 <br /> (Request will be incorporated with Appeal #2388 held later in the proceedings. ) <br /> #2306. Schubert - Westport - 9/24/92 <br /> IN FAVOR: K. Schubert, D. Lehman, B. Van DeWalle OPPOSED: R. Keuhling <br /> COMMUNICATION: Letters of support: B. Rosen, K. Opitz, T. Hamacher <br /> Gaskill/Dreps to grant, with conditions, permit to fill/grade and retaining <br /> walls within 300 feet of Lake Mendota. <br /> CONDITIONS: <br /> I ). That plans and specifications be prepared by a licensed engineer within <br /> the scope of the application, and filed with the Zoning Department before <br /> commencement of any work. <br /> 2). That all work be performed in compliance with approved engineering <br /> standards and all applicable governmental rules and regulations particularly <br /> Section 11 .05(4) of Dane County Zoning Ordinance. <br /> 3) . That there be filed with the Zoning Department of certificate of <br /> compliance by a licensed engineer at the completion of the oro_iect_ <br />
