MINUTES OF THE MEETING OF THE DANE COUNTY BOARD OF ADJUSTMENT COMMITTEE HELD ON May 27, 1993 The following members were present: Gaskill , Klopp, Dreps and Quackenbush Also: Fleck, Gunderman and Reynolds. Meeting called to order by Chairman Quackenbush at 6:32 P.M. in Room 2E City-County Building to hold public hearing as published by Class II Notice. MINUTES: (4/22/93 - Gaskill/Dreps to amend minutes of #2362 to read.- Lynch/Dreps to hold appeal in abeyance until May Hearing - as per request of the township. Also, #2363 finding of fact to read: FINDING OF FACT: I ). Zoning permit was issued prior to Zoning Department making field inspections. 2). Site plan provided by permit issuance shows adequate yards. 3). Present owner was not responsible for building location. 4). Adjoining neighbor unwilling to sell needed lands. 5). Zoning Administrator acknowledged that legislation grandfathering such encroachment will be submitted in the near future. 6). Structure has stood for over 25 years, 10 of which were occupied by appellant, without presenting a problem as attested to by adjacent owner. Gaskill/Dreps to approve minutes as amended. Motion carried - 3-0. Appeals from previous hearings: a). #2270 - Essert - Westport - 6/25/92 Gaskill/Dreps to grant abeyance, as requested by appellant, not to exceed July Hearing. Motion carried - 3-0. *Board has directed staff to notify appellant that this request will be dealt with at July Hearing, with no further stays. #2290. Weber - Dunn - 8/27/92 (Request will be incorporated with Appeal #2388 held later in the proceedings. ) #2306. Schubert - Westport - 9/24/92 IN FAVOR: K. Schubert, D. Lehman, B. Van DeWalle OPPOSED: R. Keuhling COMMUNICATION: Letters of support: B. Rosen, K. Opitz, T. Hamacher Gaskill/Dreps to grant, with conditions, permit to fill/grade and retaining walls within 300 feet of Lake Mendota. CONDITIONS: I ). That plans and specifications be prepared by a licensed engineer within the scope of the application, and filed with the Zoning Department before commencement of any work. 2). That all work be performed in compliance with approved engineering standards and all applicable governmental rules and regulations particularly Section 11 .05(4) of Dane County Zoning Ordinance. 3) . That there be filed with the Zoning Department of certificate of compliance by a licensed engineer at the completion of the oro_iect_
