A modest sized landing deck (4' x 4' or 4' x 6' ) would be permitted <br /> without need for variance. <br /> 4). Structure will need structural repair/replacement shortly due to normal <br /> weathering. <br /> 5). Applicant has steep bank which needs stair from lawn to shore. <br /> CONCLUSION: <br /> I ). Building location subject to approval by Dane County Environmental Health <br /> Department in regards to well placement. <br /> 2). Building location subject to approval by Department of Natural Resources <br /> in regards to Wells. <br /> 3). The structure shall be removed at the owner's expense if future road <br /> improvement requires additional right-of-way. <br /> FINDING OF FACT: <br /> I ). Existing farm building presently encroaches into County Highway <br /> right-of-way. <br /> 2). Propsoal is to replace existing shed utilizing a portion of existing <br /> foundation. <br /> 3). Proposed 40' x 60' structure would than be within 4 feet of well which <br /> serves the residence. <br /> 4). County Highway Department objects to placement of proposed structure. <br /> CONCLUSION: <br /> I ). Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> Motion carried - 3-0. <br /> May 27, 1993 - Public Hearing: <br /> 4;br #2383. Appeal by Jack Bain, agent for James Zerwick for a variance from <br /> required sideyard as provided by Section 10.07(7) to permit deck/walkway <br /> addition to existing residence at 4862 Trantin Drive being Lot #25, Morris <br /> Park - Section 33, Town of Westport. <br /> IN FAVOR: C. Jones OPPOSED: --- COMMUNICATION: Town Board. <br /> Gaskill/Dreps to deny requested variance from left sideyard to permit <br /> deck/entry addition to residence. <br />
