Appeal by Jeff Evers, agent for Albert & Edwin Meier for a Special Exception Permit as provided by Section 11 .05(3) to permit filling, grading, etc. , within 300 feet of Marsh Creek in the SE 1/4 SW 1/4 - Section 6, Town of Mazomanie. IN FAVOR: J. Ewers, E & A Meier OPPOSED: --- COMMUNICATION: --- Dreps/Klopp to grant with conditions permit to fill , grade and culvert installation within 300 feet of navigable body of water. CONDITIONS: I ). That plans and specifications be prepared by a licensed engineer within the scope of the application, and filed with the Zoning Department before commencement of any work. 2). That all work be performed in compliance with approved engineering standards and all applicable governmental rules and regulations particularly Section 11 .05(4) of Dane County Zoning Ordinance. 3). That there be filed with the Zoning Department a certificate of compliance by a licensed engineer at the completion of the project. 4). Permit approval subject to issuance of a zoning permit for residential construction. 5). Special Exception Permit valid for 6 months from date of issuance of zoning permit. FINDING OF FACT: I ). Proposed project to construct drive and install culverts within 300 feet of March Creek and/or any tributaries thereof. 2). Property has flood zone restrictions and project will require flood zone permit. 3). Driveway is intended to serve proposed residential construction. 4). When and if project becomes reality necessary engineering will be provided. CONCLUSION: I ). The project as planned, with specified conditions; will not result in substantial detriment to navigable waters by erosion, sedimentation, impairment of fish or aquatic life, or safe and healthful conditions. Motion carried - 3-0. Other Business as Permitted by Law: Board will tentatively reschedule inspection trip to Tuesday June 15th - confirmation to follow. Gaskill/Klopp to adjourn.
