MINUTES OF THE MEETING OF THE DANE COUNTY <br /> April 22, 1993 <br /> COMMITTEE HELD ON BOARD OF ADJUSTMENT <br /> The following members were present: Gaskill, Klopp, Lynch, Quackenbush and <br /> Dreps. <br /> Also: Fleck, Gunderman and Reynolds. <br /> Meeting called to order at 6:30 P.M. in Room 2E City-County Building to hold <br /> public hearing as published by Class II Notice. <br /> Gaskill/Dreps to approve minutes of February 25, 1993 and March 18, 1993. <br /> Motion carried - 3-0. (Lynch and Klopp - Abstain). <br /> APPEALS FROM PREVIOUS HEARINGS: <br /> #2359 - Engen - Windsor - 3/25/93 P.H. <br /> Gaskill/Dreps to hold appeal in abeyance until May Hearing to allow applicant <br /> to appear before Town Board. <br /> Motion carried - 3-0 (Quackenbush and Klopp - abstain). <br /> #2362 - Howick - Westport - 3/25/93 P.H. <br /> APPEARANCE: D. Howick <br /> Lynch/Dreps to hold appeal in abeyance until May Hearing. <br /> Motion carried - 3-0. (Quackenbush and Klopp abstain). <br /> #2363 - Hartung - Windsor - 3/25/93 P.H. <br /> APPEARANCE: L. Hartung <br /> Gaskill/Dreps to grant variance of 14.7 feet. from required total sideyard <br /> (combined) which has effect of permitting left side of existing residence <br /> within 6.1 feet of left line. <br /> FINDING OF FACT: <br /> 1). Zoning permit was issued prior to Zoning Department making field <br /> inspections. <br /> 2). Site plan provided for permit issuance shows adequate yards. <br /> 3). Present owner was not responsible for building location. <br /> 4) . Adjoining neighbor unwilling to sell needed lands. <br /> 5). Zoning Administrator acknowledged that legislation grandfathering such <br /> encroachment will be submitted in the near future. <br /> CONCLUSION: <br /> 1) . Variance is not contrary to rights of others or to the public interest. <br /> 2). Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> Motion carried - 4-0 (Klopp - abstain). <br /> #2366 - Nelson - Dunn - 3/25/93 P.H. <br /> APPEARANCE: M. Nelson <br /> Gaskill/Dreps to deny requested variance from setback to Beale Street <br /> right-of-way and left sideyard. <br /> FINDING OF FACT: <br /> 1). Appeal is a re-application of previous denial (Variance 2129 - 5/23/91) <br /> without substantive changes. <br />
