Unnecessary hardship was not proven. <br /> Motion carried - 3-1. Lynch, no. (Klopp, abstain). <br /> #2367 - Skram - Cottage Grove - 3/25/93 <br /> APPEARANCE: J. Schuchardt <br /> Gaskill/Lynch to deny requested Variance from maximum average height of <br /> accessory building in residence district to allow garage as constructed. <br /> FINDING OF FACT: <br /> 1). Structure is new construction to which permit issued with 12 foot average <br /> height limit is endorsed. <br /> 2). Agent testified plan changed to accommodate higher door for pick-up truck <br /> with top mounted running lights. <br /> 3). No other Variances granted for similar height buildings in subdivision <br /> nor surrounding areas. <br /> 4). Appears alternative design could have accommodated required door height <br /> and maintained permitted average. <br /> CONCLUSION: <br /> 1). Bowen OPPOSED: --- COMMUNICATION: Town Board <br /> Dreps/Gaskill to grant, with condition, Variance of 10 feet from required <br /> setback to Camp Leonard Road to permit construction of residential garage. <br /> CONDITION: 1). That existing storage building, located within required <br /> sideyard and without permit, be removed from property. <br /> FINDING OF FACT: <br /> 1). Proposed location is consistant with other structures and several <br /> Variances for similar locations issued recently. <br /> 2). Camp Leonard, prior to adjoining Plat of Babcock Park recording required <br /> a 20 foot minimum required setback. <br /> 3). Proposal is for a modest 16' x 20' garage to shield vehicle from elements. <br /> CONCLUSION: <br /> 1). Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> 2). Variance is necessary to provide right enjoyed by others. <br /> Motion carried - 3-0. (Quackenbush and Klopp, abstain). <br /> #2371. Appeal by Tim West, agent for Estelle Lauria for a Special Exception <br /> Permit as provided by Section 11.05(3) to permit filling, grading, etc., <br /> within 300 feet of Lake Kegonsa at 1938 Barber Drive being Lots 28 and 29 Rock <br /> Elm Park Extension Lots 28-A and 29-A. Addition to Rock Elm Park Extension - <br /> Section 26, Town of Dunn. <br />
