MINUTES OF THE MEETING OF THE DANE COUNTY <br /> BOARD OF ADJUSTMENT <br /> COMMITTEE HELD ON February 25, 1993 <br /> The following members were present: Dreps, Gaskill, and Quackenbush. <br /> Also, Fleck, Gunderman, and Schutte. <br /> Meeting called to order at 6:30 P.M. in Room 2E by Chairman Quackenbush to <br /> hold public hearing as published by Class II Notice. <br /> MINUTES: A point of order was raised by Dreps: The minutes of any meeting <br /> may only be approved by vote of three or more members who were present at that <br /> meeting. Quorum unavailable for meetings of 12/17/92, and 1/28/93. The Board <br /> agreed to abey approval of minutes for these meetings to a later date when a <br /> quorum could be called. <br /> APPEALS FROM PREVIOUS HEARINGS: <br /> #2270. Essert - Westport - 6/25/92 P.H. <br /> APPEARANCES: Edmund Essert, Shirley Essert, Attorney Troy Hellenbrand. <br /> Dreps/Gaskill to defer request to May Public Hearing to allow applicant to <br /> investigate ways to comply with septic system regulations and possible grant <br /> availability. <br /> Motion carried - 3-0. <br /> #2306. Schubert - Westport - 9/24/92 P.H. <br /> Gaskill/Dreps to postpone Special Exception Permit question until March Public <br /> Hearing to allow it to be heard with Appeal of Zoning Administrator's <br /> Interpretation, with condition that any further written materials be submitted <br /> to Zoning Department by March 17 and copied to all parties involved. <br /> Motion carried - 3-0. <br /> #2319. Gluth - Dunn - 10/22/92 P.H. <br /> APPEARANCES: Earl Gluth, Jill Gluth. <br /> OPPOSED: --- COMMUNICATION: --- <br /> Special Exception Permit: Gaskill/Dreps to grant, with conditions, permit to <br /> fill and grade within 300 feet of Lake Kegonsa including two existing boulder <br /> retaining walls, proposed grading, and underground drain tile as per plans <br /> submitted by R.E. Sarko and Associates, Inca <br /> CONDITIONS: <br /> 1) . That plans and specifications be prepared by a licensed engineer within <br /> the scope of the application, and filed with the Zoning Department before <br /> commencement of any work. <br /> 2). The all work be performed in compliance with approved engineering <br /> standards and all applicable governmental rules and regulations particularly <br /> Section 11.05(4) of Dane County Ordinance. <br /> 3). That there be filed with the Zoning Department a certificate of <br /> compliance by a licensed engineer at the completion of the project. <br /> 4). Completion deadline, including engineer's certification by June 30, 1993. <br /> FINDING OF FACT: <br /> 1). Engineer's plans and specifications satisfy drainage concerns by <br /> incorporating previous Special Exception Permit #1750 and providing <br /> underground drainage tile along West property line. <br /> 2). Two boulder retaining walls have been constructed. Filling is proposed <br /> between west and north sides of existing house and proposed breezeway. No <br /> further site grading will be done. <br />
