Zoning permit for residence showed crawl space. Owner made change to <br /> full basement by phone call to Zoning Staff. House was constructed with four <br /> feet of basement walls exposed. <br /> 2). Original house plans show permitted at-grade stoop on east side. Raised <br /> entryway is one of three existing entrances to house (raised side stoop, lake <br /> side deck, proposed breezeway). <br /> 3). Creating berm to raise east side grade to raised door elevation would <br /> require 8 more or less foot wall and revised drainage plans. New Special <br /> Exception Permit would be required. <br /> 4). Lower level entry with interior stairway is structurally difficult but <br /> possible. <br /> CONCLUSION: <br /> 1). Information <br /> submitted indicates this is a nonconforming multiple-family use. <br /> Dreps/Gaskill to grant variance of 16.25 more or less feet from required <br /> setback from road to permit first floor and second floor porches as <br /> constructed over existing footprint. <br /> FINDING OF FACT: <br /> 1). Staff report settles question of "grandfathered" status of multiple <br /> family use. <br /> 2). Porch was built over an existing foundation and extends no closer to the <br /> roadway than the previous porch. <br /> CONCLUSION: <br /> 1). Variance is not contrary to rights of others or to the public interest. <br /> 2). Variance preserves the Zoning Ordinance as much as possible without <br /> injustice to applicant. <br /> Motion carried - 3-0. <br /> #2324.
