BOA 2/25/93 Minutes <br /> Page 4 <br /> Dreps/Gaskill to grant, with condition, variance of 13 more or less feet from <br /> normal high watermark to permit proposed addition over footprint of existing <br /> garage. <br /> CONDITION: Modification of plans as submitted is required; proposed addition <br /> may not exceed, by even one inch, the exact footprint of the existing garage <br /> within the 75 foot setback. <br /> FINDING OF FACT: <br /> 1). Original zoning permit for house and garage did not indicate any setback <br /> requirement or distance to normal high V'dterline. Existing records indicate <br /> that the existing house and garage were apparently considered to be <br /> constructed legally. A more accurate determination of setback from normal <br /> high watermark is needed. <br /> 2). Hill and water line on south side, road on west side, and septic tank on <br /> east side limit other possible locations of proposed addition. Owner cannot <br /> build over existing house while living in it. <br /> 3). Cantilevered portion of proposed living room and proposed deck off master <br /> bedroom extend beyond existing walls of garage. Modification of plans and/or <br /> survey to show exact location of 75 foot setback line may permit some or all <br /> of cantilever and/or deck to be constructed beyond the 75 foot setback. <br /> CONCLUSION: _ <br /> 1). Variance preserves the Zoning Ordinance as much as possible without <br /> injustice to applicant. <br /> 2) . Variance is not contrary to rights of others or to the public interest. <br /> Motion carried - 3-0. <br /> #2355. Appeal by John G. Doerfer for a variance from required rearyard as <br /> 41, provided by Section 10.126(8) to permit addition to existing residence as <br /> constructed at 6391 Whalen Road in the NE 1/4 SE 1/4 - Section 24, Town of <br /> - <br /> Verona. <br /> IN FAVOR: John Doerfer OPPOSED: --- COMMUNICATION: ---. <br /> Gaskill/Dreps to grant variance of 28 more or less feet to required rear yard <br /> setback to permit porch addition to residence as per previous Variance #2187 <br /> granted 10/24/91. <br /> FINDING OF FACT: <br /> 1. Applicant failed to obtain Zoning Permit for porch within one year of <br /> variance. <br /> 2. No change in situation as previously considered. <br /> CONCLUSION: <br /> 1. Variance preserves the Zoning Ordinance as much as possible without <br /> injusti ce to applicant. <br /> Motion carried - 3-0. <br /> #2356. Appeal by Ron L. Kling, agent for James Swigart for a variance from <br /> required setback from road as provided by Section 10.17(5) to permit garage <br /> addition to existing residence as constructed. Also, for a Special Exception <br /> Permit as provided by Section 11.05(3) to permit filling, grading retaining <br /> wall etc. , within 300 feet of Lake Waubesa at 2927 Camp Leonard Road, being <br /> Lot #6, Camp Leonard - Section 4, Town of Dunn. <br /> IN FAVOR: Ron Kling, Arden Sandsness - Royal Oak Engineering OPPOSED: <br /> --- COMMUNICATIONS: Town of Dunn; letters from Robert L.
