BOA MINUTES 10/24/96 <br /> PAGE 2 <br /> 4rhir <br /> 1) . That plans and specifications be prepared by a licensed <br /> engineer within the scope of the application, and filed with <br /> the Zoning Department before commencement of any work. <br /> 2) . That all work be performed in compliance with approved <br /> engineering standards and all applicable governmental rules <br /> and regulations particularly Section 11 . 05 (4) of Dane County <br /> Code of Ordinances . <br /> 3) . That there be filed with the Zoning Department a <br /> Certificate of compliance by a licensed engineer at the <br /> completion of the project. <br /> 4) . Subject to all other necessary governmental agency <br /> approvals . <br /> 5) . Inspection and approval by Zoning Department upon <br /> completion of project. <br /> 6) . Cover of disturbed area be accomplished with sod. <br /> 7) . Completion and certification deadline of November 5, <br /> 1996. <br /> FINDING OF FACT: <br /> 1) . Applicant constructed new residence on lot that <br /> formerly held ponded water. <br /> 2) . Property had similar drain system which was removed <br /> during construction. <br /> 3) . Adjoining owner complained of basement flooding which <br /> had previously not occurred. <br /> 4) . Engineering provided by Ken Coffeen Professional <br /> Engineer of Mead & Hunt. <br /> CONCLUSION: <br /> 1) . The project as planned, with specified conditions; will <br /> not result in substantial detriment to navigable waters by <br /> erosion, sedimentation, impairment of fish or aquatic life, <br /> or safe and healthful conditions . Motion carried 4-0 . <br /> #2778 . Appeal by Vito Gervasi for a variance from required <br /> sideyard as provided by Section 10 . 13 (6) and 10 . 11 (7) to <br /> permit addition to existing commercial building at 2611 W. <br /> Beltline Highway in the SW 1/4 SW 1/4 Section 34, Town of <br /> Madison. <br /> IN FAVOR: V. Gerasi OPPOSED: --- COMMUNICATION: --- <br /> GASKILL/KAY to grant variance of 8 . 7 feet from required <br /> right sideyard to permit storage addition to existing <br /> commercial building as proposed. <br /> C <br />
