BOA MINUTES 5/23/96 <br /> PAGE 1 <br /> rr <br /> BOARD OF ADJUSTMENT MINUTES <br /> MAY 23, 1996 <br /> PRESENT: Gaskill, Klopp, Quackenbush and Sayles. <br /> ALSO: Reynolds . <br /> Meeting called to order at 6: 30 P.M. in Room 2-E City-County <br /> Building by Chair Quackenbush to hold Public Hearing as <br /> published by Class II Notice. <br /> MINUTES : GASKILL/SAYLES to approve minutes of April 18 and <br /> April 25, 1996. Motion carried - 4-0. <br /> May Public Hearing Items: <br /> #2730 . Appeal by Jack Schulenberg for a variance from <br /> required setback from road as provided by Section 10 . 17 (3) <br /> to permit storage shed construction at 4409 Blue Mounds <br /> Trail - in the SW 1/4 NE 1/4 and NW 1/4 SE 1/4 - Section 9, <br /> Town of Vermont . <br /> 411, --- <br /> IN FAVOR: J. Schulenberg OPPOSED: --- COMMUNICATION: <br /> KLOPP/SAYLES to grant with condition variance of 17 feet <br /> from required setback to centerline of Blue Mounds Trail <br /> permit a 40' x 30' accessory building. <br /> CONDITIONS <br /> 1) . Maximum building size is 40 feet parallel to road and <br /> 30 feet in depth with door height not to exceed 11 feet. <br /> FINDING OF FACT: <br /> 1) . Buildable area of lot backs up to steep hill and town <br /> ordinances prohibit excavation. <br /> 2) . Applicant' s property is on the outside Of a curve and <br /> structure will not obstruct vision of approaching traffic. <br /> 3) . Residence is former cheese factory and located, a <br /> portion of which, within road right-of-way. <br /> 4) . Similar variances previously granted under similar <br /> circumstances . <br /> CONCLUSION: <br /> 1) . Variance preserves the zoning ordinance as much as <br /> possible without injustice to applicant. <br /> 2) . Variance is not contrary to rights of others or to the <br /> public interest. <br /> Motion carried - 4-0 . <br /> L <br />
