BOA MINUTES 5/23/96 <br /> PAGE 5 <br /> Cirr <br /> GASKILL/KLOPP to grant variance of 71 feet to normal high <br /> watermark and variance of 4 . 7 feet to right sideyard to <br /> permit deck, garage and second story additions to existing <br /> residence as proposed. <br /> FINDING OF FACT: <br /> 1) . Application is almost identical to previous approval <br /> from July, 1994 (Appeal #2525) and never built. <br /> 2) . Second story addition is 12' further landward from <br /> normal high watermark than previous 1994 approval . <br /> 3) . The only change to existing footprint is garage addition <br /> to which only small portion encroaches into 75 feet required <br /> setback. <br /> 4) . Property is in an area of numerous non-conforming <br /> structure and numerous variances granted. <br /> CONCLUSION: <br /> 1) . Variance is not contrary to rights of others or to the <br /> public interest. <br /> 2) . Variance preserves the zoning ordinance as much as <br /> possible without injustice to applicant. <br /> Motion carried - 3-1 (Sayles, no) <br /> #2736. Appeal by Wisconsin Electric Power Company for a <br /> Special Exception Permit as provided by Section 11 . 05 (3) to <br /> permit filling, grading, etc. , within 300 feet of unnamed <br /> tributary to Maunesha River on property located North of <br /> 5635 Cherry Lane in the NE 1/4 SE 1/4 - Section 14, Town of <br /> Medina. <br /> IN FAVOR: D. Bristol, G. Maas OPPOSED: --- <br /> COMMUNICATION: Town Board <br /> KLOPP/SAYLES to grant with conditions permit to fill/grade, <br /> within 300 feet of tributary to Maunesha River, as proposed. <br /> CONDITIONS : <br /> 1) . That plans and specifications be prepared by a licensed <br /> engineer within the scope of the application, and filed • <br /> with the Zoning Department before commencement of any <br /> work. <br /> 2) . That all work be performed in compliance with approved <br /> engineering standards and all applicable governmental <br /> rules and regulations particularly Section 11 . 05 (4) of <br /> Dane County Code of Ordinances. <br /> 3) . That there be filed with the Zoning Department a <br /> Certificate of compliance by a licensed engineer at the <br /> completion of the project. <br /> 4) . Subject to all other necessary governmental agency <br /> (110. approvals. <br />
