Solner OPPOSED: --- COMMUNICATION: Town <br /> Board <br /> GASKILL/KLOPP to grant variance of 7 . 33 feet from required <br /> (16, setback to right-of-way of Morris Court to permit addition <br /> to existing residence as proposed. <br /> FINDING OF FACT: <br /> 1) . Applicant proposes garage addition/expansion to <br /> existing residence. <br /> 2) . Morris Court Road has been physically relocated however <br /> vacation of right-of-way has yet to occur. <br /> 3) . Variances have been granted to adjoining properties for <br /> similar additions. <br /> 4) . When vacation of right-of-way takes place variance will <br /> be moot. <br /> CONCLUSION: <br /> 1) . Variance preserves the zoning ordinance as much as <br /> possible without injustice to applicant. <br /> 2) . Variance is not contrary to rights of others or to the <br /> public interest.
