Motion carried - 4-0 . #2674 . Flaig - Cross Plains - 10/26/95 IN FAVOR: B. Flaig KLOPP/GASKILL grant with conditions, Special Exception Permit to fill and grade to construct drainage swale around residence as proposed. 1) . That plans and specifications be prepared by a licensed engineer within the scope of the application, and filed with the Zoning Department before commencement of any work. 2) . That all work be performed in compliance with approved engineering standards and all applicable governmental rules and regulations particularly Section 11 . 05 (4) of Dane County Code of Ordinances . 3) . That there be filed with the Zoning Department a Certificate of compliance by a licensed engineer at the completion of the project. 4) . Subject to all other necessary governmental agency approvals . 5) . Inspection and approval by Zoning Department upon completion of project. 6) . Permit valid April 26, 1996 thru May 31, 1996. FINDING OF FACT: 1) . Request is a continuation of request originally heard on October 26, 1995 and was unable to complete prior to on- set of Winter weather. 2) . Applicant has constructed residence, driveway and completed most lot grading. 3) . Residence is constructed into a hill and run-off, without a swale to divert, would wash into backside of residence . 4) . Engineering provided by Aleck Cheney, Professional Engineer. CONCLUSION: 1) . The project as planned, with specified conditions; will not result in substantial detriment to navigable waters by erosion, sedimentation, impairment of fish or aquatic life, or safe and healthful conditions.
