BOA 4/25/96 <br /> Page 4 <br /> tor SAYLES/GASKILL to deny both requested variances, from height <br /> and area, to permit larger on-premise pylon sign than <br /> permitted by ordinance. <br /> FINDING OF FACT: <br /> 1) . Proposed sign is to replace existing sign and logo for <br /> service station. <br /> 2) . Sign is pre-fabricated factory made and slight <br /> modifications can bring signs within requirements of sign <br /> ordinance. <br /> 3) . Section 10. 74 (19) dictates maximum area and maximum <br /> height of signs based upon adjacent highway speed limit . <br /> 4) . Town Board has recommended denial . <br /> CONCLUSION: <br /> 1) . Unnecessary hardship was not proven. <br /> Motion carried - 4-0 . <br /> #2728 . Appeal by Mills Street Partners and James M. <br /> Corcoran for a variance from required lot width and lot area <br /> as provided by Sections 10. 05 (4) and 11 . 03 (1) to permit lot <br /> line adjustment by CSM at 4862 Trantin Court being Lot 23, <br /> and part Lot #22, Block #1, Morris Park and additional <br /> lands in the SW 1/4 SW 1/4 - Section 33, Town of Westport . <br /> IN FAVOR: S . Lewis, J. Corcoran OPPOSED: --- <br /> COMMUNICATION: Town Board <br /> GASKILL/SAYLES to deny requested variance of 30 feet from <br /> required minimum lot width within shoreland zoning district <br /> to allow lot reconfiguration by Certified Survey Map. <br /> FINDING OF FACT: <br /> 1) . Applicant proposes to reconfigure 4 existing lots into <br /> 2 lots for residential use. <br /> 2) . Combining 2 original platted lots would conform to <br /> minimum required lot width and area, thereby variances not <br /> necessary. <br /> 3) . Properties have limited buildable area due to shoreland <br /> setback and setback from indian mounds . <br /> 4) . Properties to be served by access easements yet to the <br /> okayed by town. <br /> CONCLUSION: <br /> 1) . Unnecessary hardship was not proven. <br /> Roll Call : Sayles, aye, Klopp, no, Gaskill, aye, <br /> Quackenbush, aye. Motion carried - 3-1 (Klopp, no) . <br /> #2729.
