BOA 4/25/96 <br /> Page 3 <br /> 6) . Permit valid starting May 1, 1996 and ending, including <br /> certification deadline of May 31, 1996. <br /> FINDING OF FACT: <br /> 1) . Driveway and residence construction adjoin tributary to <br /> Black Earth Creek. <br /> 2) . Stockpiled topsoil and down slope side of project to <br /> utilize properly installed and maintained silt fence. <br /> 3) . Site is accessed CTH KP by former field road access . <br /> 4) . Engineering and certification provided by Aleck Cheney <br /> Professional Engineer. <br /> CONCLUSION: <br /> 1) . The project as planned, with specified conditions; will <br /> not result in substantial detriment to navigable waters by <br /> erosion, sedimentation, impairment of fish or aquatic life, <br /> or safe and healthful conditions . Motion carried - 4-0 . <br /> #2725. Appeal by John & Rita Wacker for a variance from <br /> required setback from road as provided by Section 10 . 17 (2) <br /> to permit addition to existing residence at 5598 CTH J in <br /> the SW 1/4 NW 1/4 - Section 26, Town of Vermont. <br /> IN FAVOR: J. Wacker OPPOSED: --- COMMUNICATION: County <br /> Highway <br /> KLOPP/SAYLES to grant variance of 15± feet to right-of-way <br /> line of CTH J to permit entryway to existing residence as <br /> constructed. <br /> FINDING OF FACT: <br /> 1) . Applicant has rebuilt old entry, which was in need of <br /> repair, without benefit of required permits . <br /> 2) . Residence is former cheese factory and actually extends <br /> into Highway right-of-way. <br /> 3) . 8' x 10' entryway is 33' further from centerline than is <br /> nearest point of right-of-way incursion. <br /> 4) . County Highway does not object. <br /> CONCLUSION: <br /> 1) . Variance preserves the zoning ordinance as much as <br /> possible without injustice to applicant. <br /> 2) . Variance is not contrary to rights of others or to the <br /> public interest. <br /> Motion carried - 4-0 . <br /> #2726. (WITHDRAWN BY APPLICANT) . <br /> #2727 .
