BOA MINUTES / 2/22/96 <br /> Page 1 <br /> tr, <br /> BOARD OF ADJUSTMENT MINUTES <br /> MINUTES OF FEBRUARY 22, 1996 <br /> PRESENT: Quackenbush, Klopp and Sayles <br /> ALSO: Gunderman and Reynolds <br /> Meeting called to order by Chairman Quackenbush at 6: 30 P.M. <br /> in Room 2-E City-County Building to hold public hearing as <br /> published by Class II Notice. <br /> MINUTES : Minutes of January 25, 1996 Pages 2 thru 9 labeled <br /> "ZNR MINUTES" will be corrected to read "BOA MINUTES". <br /> KLOPP/SAYLES to approve minutes of January 23 and January <br /> 25, 1996. Motion carried - 3-0. <br /> YEERUARY PUBLIC REARING ITEMS: <br /> #2706 . Appeal by Tara Einsweiler-Mickelson & Randy <br /> Mickelson for a variance from required setback from road, <br /> side and rear yards as provided by Sections 10. 07 (7) & (8) <br /> and 10 . 16 (5) (b) to permit residence and decks as constructed <br /> at 604 Christianson Avenue being Lot 2, CSM #6363, in the NE <br /> 1/4 NE 1/4 Section 5, Town of Blooming Grove. <br /> IN FAVOR: R & T Mickelson, C. Blackburn OPPOSED: --- <br /> COMMUNICATION: --- <br /> SAYLES/KLOPP to grant variance of 8' from required setback <br /> to Furey Avenue to permit deck/entry to encroach 4' into <br /> setback area equal width to existing patio door. <br /> KLOPP/SAYLES to grant variance of 0 .25 feet from required <br /> right sideyard to permit deck as constructed. <br /> KLOPP/SAYLES to grant variance of 0. 71 feet from required <br /> rearyard to permit existing residence as constructed. <br /> FINDING OF FACT: <br /> 1) . Residence constructed in 1991 with rearyard violation. <br /> 2) . 2 Decks constructed by previous owner without benefit <br /> of required permits . <br /> 3) . Steps will have to be relocated toward rearyard to <br /> minimize sideyard encroachment . <br /> 4) . Entryway/deck (Furey side) actually encroaches into <br /> town road right-of-way. <br /> 5) . Reduction of Furey Avenue deck allows useable access <br /> while not precedent setting. <br /> 6) . Althought property is in an area of numerous non- <br /> conforming structures encroachments were self created <br /> hardships . <br /> CONCLUSION: <br />
